HomeMy WebLinkAboutResolution - 082560L - Request Grant Permit - Construction Of North-South Roadway Across Loop 289 - 08_25_1960 FOS wig RESOLUTION O WHEREAS, the City of Lubbock has acquired for the State of Texas a portion 4..., of right of way for Loop 289 in Section 4, Block E, Lubbock County, Texas; and, WHEREAS, the State of Texas through its Highway Commission and State Highway Department find that it is not economical to construct this segment of Loop 289 at the present time; and, WHEREAS, the developers and owners of the property adjacent to this seg- ment of right of way desire to develop the area South of the right of ways and, WHEREAS, there is no dedicated access to the property abutting said Loop 289; NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK SECTION 1. THAT, the City of Lubbock acting by and through its City Manager who is hereby directed and authorized to request the State Highway De- partment to grant a.permit for the construction of temporary North-South roadway across the segment of Loop 289 at Avenue U in the City of Lubbock and be it furthe resolved that such permits be granted subject to such roadway being declared a temporary crossing only until such time as the State of Texas provides the propert abutting said Loop 289 with access to said Loop and that the cost of pavingany sucli temporary roadway to be at the cost of any owner of land abutting said Loop 289 or other person requesting such temporary roadway that such permit be further conditioned that the owner of land abutting said Loop 289 or other person request- ing such temporary roadway shall provide without cost to the City of Lubbock a sig or signs of suitable wording stating that such crossing is a temporary- roadway and further conditioned that the City of Lubbock shall install and maintain any such sign or signs until notified by the State of Texas that such crossing is declared abandoned when and after the State of Texas provides access to such abutting prope ty to Loop 289. SECTION 2. Be it further resolved that a copy of the permit granted by the State of Texas shall be recorded in the Deed Records of'Lubbock County, Texas.
