WHEREAS, the City of Lubbock and the State of Texas, by and through
the State Highway Commission, have entered into a contract as empowered
and authorized by Art. 6673-b, Vernon's Annotated Civil Statutes, providing
for the location, construction and maintenance of that fai f ArdState
Highway system, which has heretofore been designated as ep= y the State
Highway Commission; and,
WHEREAS, under the terms of the contract the procurement and acquisition
of the necessary land needed for road right of way purposes is the obligation
of the City of Lubbock; and,
WHEREAS, the State Highway Commission has deemed it a IP order
to make certain highway improvements in connection with sai
situated in and adjacent to the City of Lubbock and to the end that this
purpose be accomplished, the necessity of which is hereby confirmed by the
City Commission of the City of Lubbock, it is necessary that fee simple title
to the land hereinafter described be acquired by the City of Lubbock in
fulfillment and satisfaction of its contractual obligations to the State of
Texas; and,
WHEREAS B. E. Sewell, et ux Florence Sewell
own or have some character)I n eo�e i(p land needed for the location, construc-
tion and maintenance of sai and the value and total damages to the
owners for the fee simple title to said land have been appraised in the amount
of $, 50385.00 and the Commission finds said amount to be fair
and equitable; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
THAT the fee simple title to the following described land situated in
Lubbock County, Texas, be acquired by the City of Lubbock for and on behalf
of the State of Texas for the purpose of opening, contaustid maintaining
in conjunction with the State Highway Commission, sai k2- as a
designated part of the State Highway System, which land is more particularly
described as follows:
Four tracts of land out of Block 2, Gordon-Bozeman Addition to Lubbock,
Lubbock County, Texas and conveyed to B. E. Sewell and Florence Sewell by
deed dated November 27, 1956, of record in Volume 640 and Page 163, Deed
Records of Lubbock County, Texas, which four tracts of land are more
particularly described as follows:
Tract 12-1. A tract of land out of Lot 8, Block 2, in mid Addition: Beginn-
ing at the north corner of said Lot 8 on the present southeasterly right of
way line of U.S. Highway 62 & 82; Thence S 45*51' Vi 50.0 feet with the
northwesterly line of Lot 8 and said right of way line to the west corner of
Lot 8; Thence S 44*09, E 6.8 feet with the southwesterly line of Lot 8;
Thence N 41*55.4' E 501 feet across Lot 8 to the northeasterly line of Lot 8;
Thence N 44*09' W 3.3 feet with said lot line to the point of beginning; and
contains 0.006 acre.
Tract 12-2. A tract of land out of Lots 9 & 10, Block 2, in said addition:
Beginning at the north corner of Lot 9 on the present southeasterly right of
way line of U.S. Highway 62 & 82; Thence S 45*51, W 100.0 feet with the north -
westerly line of Lots 9 & 10 and said right of way line to the west corner of
Lot 10; Thence S 44*09' E 13.6 feet with the southwesterly line of Lot 10;
Thence N 41*55.4' E 100.2 feet across Lots 10 & 9 to the northeasterly line
of Lot 9; Thence N 44°09' W 6.8 feet with mid .lot line to the point of
beginning; and contains 0.023 acre.
Tract 12-3. A tract of land out of Lots 11 & 12, Block 2, in said addition:
Beginning at the north corner of Lot 11 on the southeasterly right of way lin
of U.S. Higliway 62 & 82; Thence S 450511 W 100.0 feet with the northwesterly
line of Lots 11 & 12 and said right of way line to the west corner of Lot 12;
Thence S 44109' E 20.5 feet with the southwesterly line of Lot 12; Thence
N 41055.4, E 100.2 feet across Lots 12 & 11 to the northeasterly line of
Lot 11; Thence N 441091 W 13.6 feet with said lot line to the point of
beginning; and contains 0.039 acre.
Tract 12-4. A tract of land out of Lot 13, Block 2, in said addition;
Beginning at the north corner of Lot 13 on the southeasterly right of way
line of U.S. Highway 62 & 82; Thence S 45®51' YJ 50.0 feet with the northwest-
erly line of Lot 13 and said right of way line to the west corner of Lot 13;
Thence S 44109' E 23.9 feet with the southwesterly line of Lot 13 ; Thence
N 41055.4, E 50.1 feet across Lot 13 to the northeasterly line of said lot;
Thence N 44*09' W 20.5 feet with said lot line to the point of beginning;
and contains 0.026 acre.
Total area of Tracts 12-1 through 12-4: 0.094 acre.
THAT the owners of said land be offered, through the Right of Way
Department, the amount appraised as the value and total damages for the fee
simple title and acquisition of said land for the purposes herein stated,
for the use and benefit of the City of Lubbock and State of Texas, and
unless accepted forthwith the City Attorney is hereby authorized and instruc
ted to institute condemnation proceedings to acquire the fee simple title
to said land as hereinabove described for highway purposes.
Approved and passed by unanimous vote of the Commission this 11th
day of August , 19 60 .
