Underwood - Section 3 Block A - 07_28_1960 RE S OLUT ION WHEREAS, the City of Lubbock and the State of Texas, by and through the State Highway Commission, have entered into a contract as empowered and authorized by Art. 6673-b, Vernon's Annotated Civil Statutes, providing for the location, construction and maintenance of that WooUldState Highway system, which has heretofore been designated as y the State Highway Commission; and, WHEREAS, under the terms of the contract the procurement and acquisition of the necessary land needed for road right of way purposes is the obligation of the City of Lubbock; and, WHEREAS, the State Highway Commission has deemed it nacelta in order to make certain highway improvements in connection with saidl situated in and adjacent to the City of Lubbock and to the end that this purpose be accomplished, the necessity of which is hereby confirmed by the City Commission of the City of Lubbock, it is necessary that fee simple title to the land hereinafter described be acquired by the City of Lubbock in fulfillment and satisfaction of its contractual obligations to the State of Texas; and, WHEREAS M. G. Underwood own or have some character i. ,�Hw&dland needed for the location, construc- tion and maintenance of sai A , and the value and total damages to the owners for the fee simple title to said land have been appraised in the amount of $_,I.c)49.00 and the Commission finds said amount to be fair and equitable; NOW THEREFORE: BE IT RESOLVED BY THE CITY CM24I5SION OF THE CITY OF LUBBOCK: THAT the fee simple title to the following described land situated in Lubbock County, Texas, be acquired by the City of Lubbock for and on behalf of the State of Texas for the purpose of opening, const�c�JARg�$ maintaining in conjunction with the State Highway Commission, said ix as a designated part of the State Highway System, which land is more particularly described as follows: A tract of land out of the southwest quarter of Section 3 , Block A, T.T.R.R. Survey, Lubbock County, Texas: Beginning at a point in the' present north- westerly right-of-way line of U.S. Highway 62, 945.1 'feet southerly and 1,081. feet westerly from the northeast corner of the southwest quarter of said Section 3, said point being 0.3 feat southwesterly on the tangent line from the point of tangency of a curve of 16*30' central angle on said right-of-way line; Thence N 29*21' E 216.0 feet with mLid tangent and the present right-of- way line ; Thence N 18014, W 33.7 feet with said right-of-way line ; Thence N 65049' W 115.4 feet with said right-of-way line to the beginning of a curve; Thence northwesterly 120.5 feet (through a central angle of 6°40' ) with said right-of-way line curve to the left of radius 1,035.9 feet to a point from which the center of said curve bears S 17*31' W; Thence southerly 382.1 feet with a circular curve to the right , of which the center bears S 17*31' W 215.0 feet from the beginning of t`.is course (through a central angle of 101°50' ) to r... the point of beginning; Containing 0.299 acre. THAT the owners of said land be offered, through the Right of Way Department, the amount appraised as the value and total damages for the fee simple title and acquisition of said land for the purposes herein stated, for the use and benefit of the City of Lubbock and State of Texas, and unless accepted forthwith the City Attorney is hereby authorized and instruc ted to institute condemnation proceedings to acquire the fee simple title to said land as hereinabove described for highway purposes.
