Don Baldridge Et Al - Section 15 Block A - 07_13_1960 RESOLUTION Cf) 15cao F i WHEREAS, the City of Lubbock and the State of Texas, by and through the State Highway Commission, have entered into a contract as empowered and authorized by Art. 6673-b, Vernon's Annotated Civil Statutes, providing for the location, construction and maintenance of that part of the State Highway system., which has heretofore been designated as Loop 289 by the State Highway Commission; and, WHEREAS, under the terms of the contract the procurement and acquisition of the necessary land needed for road right of way purposes is the obligation of the City of Lubbock; and, WHEREAS, the State Highway Commission has deemed it necessary in order to make certain highway improvements in connection with said "Loop 289" situated in and adjacent to the City of Lubbock and to the end that this purpose be accomplished, the necessity of which is hereby confirmed by the City Commission of the City of Lubbock, it is necessary that fee simple title to the land hereinafter described be acquired by the City of Lubbock in fulfillment and satisfaction of its contractual obligations to the State of Texas; and, WHEREAS J. Don Baldridge and Great National Life Insurance Company own or have some character interest in land needed for the location, construc- tion and maintenance of said Loop 289, and the value and total damages to the owners for the fee simple title to said land have been appraised in the amount of * ?.000.00 and the Corimis s ion finds said amount to be fair and equitable; NOW THEREFORE: BE IT RESOLVED BY THE CITY COMISSION OF THE CITY OF LUBBOCK: THAT the fee simple title to the following described land situated in Lubbock County, Texas, be acquired by the City of Lubbock for and on behalf of the State of Texas for the purpose of opening, constructing and maintaining in conjunction with the State Highway Commission, said "Loop 289" as a designated part of the State Highway System, which land is more particularly described as follows: 0.122 of one acre of land, more or less, off the east side of that certain tract of land out of and a part of Section 15, Block A, Lubbock County, Texas, which tract was conveyed to J. Don Baldridge by deed dated May 21, 159 of record in vol. 743, page 598, Deed Records of Lubbock County, Texas, said 0,122 of one acre tract being more .particularly described by metes and bounds as followw: BEGINNING at a point in the present right-of-way line of US 87, said point being 2167.97 feet east, 1600.91 feet south, and S 54°45'E 600.8. feet from the northwest corner of said Section 15; THENCE S 30*30' W, along'`said present right-of-way line, a distance of 200.0 feet, to a point in the'� north boundary line of a 4.362 acre tract of land described in vol. 7 page 345, Deed Records of Lubbock County, Texas, said point being 99.35 feet northwesterly from and measured at right angles to centerline C.S. 304+37.3 of a proposed relocation of said US 87; THENCE N 66021' W, a distance of 33.04 feet along the north boundary line of said 4.362 acre tract; THENCE --- N 34°o7.4' E, a distance of 206.01 feet; THENCE S 54c45, E, a distance of 19.85 feet to the point of beginning. THAT the owners of said land be offered, through the Right of Way Department , the amount appraised as the value and total damages for the fee simple title and acquisition of said land for the purposes herein stated, for the use and benefit of the City of Lubbock and State of Texas, and unless accepted forthwith the City Attorney is hereby authorized and instruc ted to institute condemnation proceedings to acquire the fee simple title to said land as hereinabove described for highway purposes.
