Raybon - Section 78 Block A - 05_26_1960 Fos �C VV KJ 1 �r N RESOLUTIO ly �5 _ WHEREAS, the City Commission of the City of Lubbock finds that;_ public necessity and convenience requires the enlargement and extension of the Cityts sanitary sewer system and further finds that an easement in, over and under the tract of land herein described is needed for right of way to construct sewer lines and appurtenances; and, WHEREAS, Mr. W. T. Raybon and wife, Nellie Raybon own said land, and damages to be paid to owner or owners for said easement have been appraised in the amount of $100, 00 and the Commission finds said amount to be fair and equitable; NOW THEREFORE: BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY .OF LUBBOC.K: THAT an easement in, over and under the following described tract of land situated in Lubbock County, Texas, be acquired by the City of Lubbock for the purpose of enlarging and extending the Cityts sewer system, said tract described as follows: A 5. 0 foot permanent easement out of Section 78, Block A, Lubbock County, Texas and being more particularly described as follows: BEGINNING at a point 4191.55 feet East and 286.38 feet North of the Southwest corner of said Section 78, said point being the Northwest corner of a tract of land recorded in Volume 423, Page 582 of the Deed Records of Lubbock County, Texas; THENCE North 269. 16 feet; THENCE East 5.0 feet; THENCE South 269. 16 feet; THENCE West 5, 0 feet to the PLACE OF BEGINNING, Be it further resolved that a temporary working easement 40 feet in width, over and under the following described tract of land situated in Lubbock County, Texas, be acquired by the City of Lubbock for the purpose of the construction and enlargement of the Cityts sanitary sewer system such temporary working ease- ment being more particularly described as follows: A 40, 0 foot temporary easement out of Section 78, Block A and being more particularly described as follows: BEGINNING at a point 4191. 55 feet East and 286.38 feet North of the Southwest corner of Section 78, Block A, said point being the Northwest corner of a tract of land recorded in Volume 423, Page 582, of the Deed Records of Lubbock County, Texas; THENCE North 269. 16 feet to a point; THENCE West 17. 5 feet; THENCE North 50..0 feet; THENCE East 40r, 0 feet; THENCE South 269, 16 feet; THENCE West 22.5 feet to the PLACE OF BEGINNING. and that such temporary easement shall automatically in all respects expire and revert to Mr. W. T. Raybon and wife, NeUie,Raybon, 30 days after the completio and installation of the permanent sanitary sewer line. THAT the owners be offered, through the Right-of-Way Department, the amount appraised as total damages for said easement, and unless accepted forth- with that condemnation proceedings be timely instituted by the City Attorney to acquire said easement in, over and under said tract of land for the purpose of constructing and maintaining sewer lines and appurtenances therein, together with full rights of ingeess, egress and regress for such purposes.
