HomeMy WebLinkAboutResolution - 052660I - Easement Acquisition - Mrs. Evelyn Raybon Webb - Section 78 Block A - 05_26_1960 FOS: g RESOLUTION WHEREAS, the City Commission of the City of Lubbock finds that public necessity and convenience requires the enlargement and extension of the City's sanitary sewer system andfurther finds that an easement in, over and under the tract of land herein described is needed for right of way to construct sewer lines and appurtenances; and, WHEREAS, Mrs. Evelyn Raybon Webb and husband Mr. Carl Wayne Webb, Jr , , own said land, and damages to be paid to owner or owners for said easement have been appraised in the amount of $100. 00 and the Commission finds said amount to be fair and equitable; NOW, THEREFORE; BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: THAT an easement in, over and under the following described tract of land situated in Lubbock County, Texas, be acquired by the City of Lubbock for the purpoae of enlarging and estending the City's sewer system, said tract described as follows: . The West 5. 0 feet of a 0, 155 acre tract of land described in Volume 423, page 582, Lubbock County, Texas, and being described as follows: BEGINNING at a point that is 1022.2 feet West and 386.38 feet South of the Northeast corner of a 22. 8 acre tract known as the Evelyn Raybon Webb and Carl Wayne Webb, Jr. tract; THENCE North 0'03t West 117.22 feet; THENCE North 89057t West 5r 0 feet; THENCE South 0003t East 117..22 feet; THENCE South 89057t West 5. 0 feet to the PLACE OF BEGINNING, Be it further resolved that a temporary working easement 40 feet in width, over and under the following described tract of land situated in Lubbock County, Texas be acquired by the City of Lubbock for thepurpose of the construction and enlargement of the City's sanitary sewer system such temporary working ease- ment being more particularly described as follows: A 40.0 temporary working easement out of Section 78, Block A, Lubbock County, Texas, and being more particularly described as follows: BEGINNING at a point that is 1022,2 feet West and 386.38 feet South of the Northeast corner of a 22. 8 acre tract known as the Evelyn Raybon Webb and Carl Wayne Webb, Jr.. tract; THENCE South 89057t West 17. 5 feet along the South line of said 22.8 acre tract; THENCE North 00031 West 336, 8 feet to the South line of a . 086 acre tract as recorded in Volume 423, Page 581 of the Deed Records of Lubbock County, Texas; THENCE East 17.5 feet along the South line of said .086 acre tract to the West line of a tract of land described in Volume 420, Page 599 of the Deed Records of Lubbock ,- County, Texas; THENCE South 00031 East 219. 16 feet to a point; THENCE North 890571 West 22,P 5 feet; THENCE South 108. 09 feet to the West line of U. S. Highway 87; THENCE South 380331 East, 14.65 feet along the West line of U. S. Highway 87; THENCE South 89057s West, llv 04 feet to the PLACE OF BEGINNING,, and that such temporary easement shall automatically in all respects expire and revert to Mrs. Evelyn Raybon Webb and husband Mr. Carl Wayne Webb, Jr. , 30 days after the completion and installation of the permanent sanitary sewer lineq THAT the owners be offered, through the Right of way Depar,trnent, �, the amount appraised as total damages for said easement, and unless accepted forth- with that condemnation proceedings be timely instituted by the City Attorney to acquire said easement in, over and under said tract of land for the purpose of constructing and maintaining sewer lines and appurtenances iherein, together with full rights of ingress, egress and regress for such purposes. 1 Approved and passed by unanimous vote of the Commission thiy 26 day o May, 1960, c.
