•) WHEREAS, the City of Lubbock and the State of Texas, by and through:
the State Highway Commission, hlave entered into a contract as empowered
and authorized by Art. 6673-b, Vernon's Annotated Civil Statutes, providing
for the location, construction and maintenance of that part of the State Highway-
system, which has heretofore been designated as Loop 289 by the State High-
way Commission; and,
WHEREAS, under the terms of the contract the procurement and acquisition
of the necessary land needed for road right of way purposes is the obligation of th
City of Lubbock; and,
WHEREAS, the State Highway Commission has deemed it necessary in orde
to make certain h}ghway improvements in connection with said "Loop 289" situate
in and adjacent to'the City of Lubbock and to the end that this purpose be accom-
plished, the necessity of which is hereby confirmed by the City, Commission of
the City of Lubbock, it is necessary that fee simple title to the land hereinafter
described be acquired by the City of Lubbock in fulfillment and satisfaction of
its contractual obligations to the State of Texas; and,
WHEREAS Docia Brown Estate and Estate of Lawrence E. Brown
own:or :have some character inter est'.in'.land needed for the location,: construction
and maintenance of said Loop 289, and the value and total damages to the owners
,.� for the fee, simple title to said land have. been appraised in the amount of
$ 87,306.00 _ and the Commission finds said amount to be fair and
e quitable; NOW THEREF ORE:
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITTY OF LUBBOCK:'
THAT the fee simple title to the following described land situated ;in Lub
bock County, Texas, be acquired by the City of Lubbock for and on,behalf of
the State of Texas for the purpose of opening, constructing and maintaining in
conjunction with the State Highway Commission, said "Loop 289" as a designated
part of the State Highway System, which land is more particularly described
as follows:
29.102 acres of land in two parcels, same being out of and a part of the
northwest one-quarter of Section 5, B lock E, which northwest one-quarter
was conveyed to Mrs. Docia Brown by deed dated 20 Oct. 31, of record in
vol. 169, page 463 , Deed Records of Lubbock County, Texas, which 29.102 acre
of land is more particularly aescribed by metes and bounds as follows:

BEGINNING at the point of intersection of the present west right-of-way
line and the north boundary line of said Section 5; THENCE S 0c04' E, 101.5
feet along said west right-of-way line, to a point; THENCE S 0011' E, 742.7
feet along said wrest right-of-way line, to a point; THENCE 11 0052' vi, 844.2
feet, to a point in the north boundary line of said Section 5; THENCE east,
10.0 feet along "said north boundary line to the place of beginning and
contains 0.097 of one acre.

BEGINNING at a point in the west boundary line of said Section 5, said
point being 1658.5 feet south of the northwest corner of said section;

of the centerline of a proposed freeway as established in the field by the
Texas Highway Department, to the beginning of a circular curve to the left;
THENCE in a northeasterly direction along said curve, the center of said curve
being N 0*03' E, 215.0 feet from the beginning of the curve, a distance of
275.0 feet, to a point; THENCE N 16040' E, 199.9 feet to the beginning of a
circular curve to the right; THENCE in a northeasterly direction along said
curve, the center of the curve being S 73020' E, 269.0 feet from the beginning
of the curve, a distance of 16.8.2 feet, to a point ; THENCE N 49050' E, 330..3
feet to the beginning of a circular curve to the left; THENCE`in a northeaster -
ly direction along said circular curve,. the center of the curve being N 40010,
W, 215.0 feet from the beginning of 'the' curve, a distance of 144.8 feet, to a
pointlin the present west right-of-way line of a highway; T HEN CE S 0*11' E,
757.3 feet along said present right-of.-way line to an angle point; THENCE S
5*321 W, 100.5 feet along said present right-of-way line to an angle point;

the south boundary line of said northwest one-quarter; THENCE Westerly, 23.8
feet along said south boundary line , to a point. on a curve to the left; "HENCE
in a northwesterly direction along said circular curve, the center of said
curve being S 54*21' W, 215.0 feet from the beginning of this call., a distance
of 69.48 feet, to a point; THENCE N 54010' W, 246.6 feet,. to a point on a
circular curve, to the right; THENCE in a northwesterly direction along said
curve, the center of the curve being N 35*50' E, 289.0 feet from the beginning
of 'the curve, a distance of 175.9 feet, to a point; THENCE N 19°17' W, 209.7
feet to the beginning of a circular curve to the left; THENCE in a northwest-
erly direction along said curve, the center of said curve being S 70*43' W,
215.0 feet from the beginning of the curve, a distance of 265.5 feet, to a
point; THENCE S 89057' W, 1928.4 feet along a line parallel to and 150.0 feet
south of the said centerline, to a point in the west boundary line of said
Section 5; THENCE northerly, 300.0 feet along the said west boundary line to
the place of beginning and contains 29.005 acres.
THAT the owners of said land be offered, through the Right of Way
Department, the amount appraised as the value and total damages for the fee
simple title and acquisition of said land for the .purposes herein stated,
for the use and benefit of the City of Lubbock and State of Texas, and
unless accepted forthwith the City Attorney is hereby authorized and instruc
ted to institute condemnation proceedings to acquire the fee simple title
to said land as hereinabove described for highway purposes.
