HomeMy WebLinkAboutResolution - 041460J - Land Acquisition - Orvill Standefer - Gordon Bozeman Addition - 04_14_1960 RESOLUTION !� WHEREAS, the City of Lubbock and the State of Texas, by and through the State Highway Commission, have entered into a contract as empowered and authorized by Art. 6673-b, Vernon's Annotated Civil Statutes, providing for the location, construction and maintenance ofdt&upRttaapf the State Highway system, which has heretofore been designated as �R:9 by the State High- way Commission; and, WHEREAS, under the terms of the contract the procurement and acquisitio of the necessary land needed for road right of way purposes is the obligation of th City of Lubbock; and, WHEREAS, the State Highway Commission has deemed 'it n Icessary in orde to make certain h_ghway improvements in connection with saiAWugR ' situate in and adjacent to!the City of Lubbock and to the end that this purpose be accom- plished, the necessity of which is hereby confirmed by the City Commission of the City of Lubbock, it is necessary that fee simple title to the land hereinafter described be acquired by the City of Lubbock in fulfillment and satisfaction of its contractual obligations to the State of Texas; and, WHEREAS Orvill Standef er own or :have some charatrotlnra�st'.im:.land needed for the location, construction and maintenance of said L=7_22V, and the value and total damages to the owners ° for the fee simple title to said land have been appraised in the amount of 00 ____ and the Commission finds said amount to be fair and equitable; NOW THEREFORE: BE IT RESOLVED BY THE CITY COMMISSION OF THE CI-TY OF LUBBOCK:° THAT the fee simple title to the following described land situated !in Lub- bock County, Texas, be acquired by the City of Lubbock for and on behalf of the State of Texas for the purpose of opening, constr It"*t* aintaining in conjunction with the State Highway Commission, sai xas a designated part of the State Highway System, which land is more particularly described as follows: Two tracts of land out of Block 6, Gordon-Bozeman Addition to Lubbock, Lubbock County, Texas: TRACT 1-1. All of Lots 8 and 9, Block 6, in said Addition, containing 0.321 acre. TRACT 1-2. All of Lot 10, Block 6, in said Addition, containing 0.161 acre. Total area of Tracts 1-1 and 1-2: 0.482 acre. Also: Five tracts of land out of Block 6, Gordon-Bozeman Addition to Lubbock, Lubbock County, Texas: TRACT 1A-1. A tract of land out of Lot 3, Block 6, in said Addition: Beginning at the east corner of said Lot 3; thence N 44*09, W 35.6 feet with the northeasterly cite of Lot 3 ; thence S 53028' W 70.6 feet to the south- westerly line of Lot 3 ; thence S 44°09' E 45.O feet to the south corner of Lot 3; thence N 45*51' E 70.O feet with the southeasterly line of Lot 3 to the point of beginning; containing 0.065 acre. _ TRACT 1A-2. A tract of land out of Lot 4, Block 6, in said Addition: B eginning at the east corner of said Lot 4; thence N 44009, W 45.0 feet with the northeasterly line of Lot 4; thence S 53028' W 70.6 feet to the south- westerly line of Lot 4; thence S 44009, E 54.4 feet to the south corner of Lot 4; thence N 45*51' E 70.0 feet with the southeasterly line of Lot 4 to the point of beginning; containing 0.080 acre. TRACT 2-A-3. A tract of land out of Lot 5, Block 6, in said Addition: Beginning at the east corner of said Lot 5; thence N 44*09, W 54.4 feet with the northeasterly line of Lot 5; thence S 53128' V1 70.6 feet to the south- westerly line of Lot 5 ; thence S 44,09, E 63.7 feet to the south corner of Lot 5; thence N 45*51' E 70.0 feet with the southeasterly line of Lot 5 to the point of beginning; containing 0.095 acre. TRACT 1A-4. A tract of land out of Lot 6, Block 6, in said Addition: Beginning at the east corner of said Lot 6; thence N 44009, 71 63.7 .feet with the northeasterly line of Lot 6; thence S 53628' W 70.6 feet to the south- westerly line of Lot 6; thence S 44009, E 73.1 feet to the south corner of Lot 6 ; thence N 45*51, E 70.0 feet with the' southeasterly line of Lot 6 to the point of beginning; containing 0.110 acre. TRACT 1A-5. A tract of land out of Lot 7, Block 6, in said Addition: Beginning at the east corner of said Lot 7; thence N 44*09, W 73.1 feet with the northeasterly line of Lot 7; thence S 53*28' SY 11.7 feet to the beginning of a circular curve ; thence southwesterly 63.8 feet with said curve to the right of radius 125.0 feet to a point in the southwesterly line of Lot 7; thence S' 44®09' E 98.5 feet to the south corner of Lot 7; thence N 45151, E 70.0 with the southeasterly line of Lot 7 to the point of beginning; containing 0.132 acre. Total area of Tracts 1A-1 through 1A-5: 0.482 acre. THAT the owners of said land be offered, through the Right of Way Department, the amount appraised as the value and total damages for the fee simple title and acquisition of said land for the purposes herein stated, for the use and benefit of the City of Lubbock and State of Texas, and unless accepted forthwith the City Attorney is hereby authorized and instruc- ted to institute condemnation proceedings to acquire the fee simple title to said land as hereinabove described for highway purposes. 1 Approved and . 1 assed by unanimous vote of the Commission thik ^th', day of K , 19 60 .
