Scott - Section 15 Block A - 03_24_1960 RESOLUTION D WHEREAS, the City of Lubbock and the State of Texas, by and through the State Highway Commission, have entered into a contract as empowered �.4 and authorized by Art. 6673-b, Vernon's Annotated Civil Statutes, providing for the .,ocation, construction and maintenance of that part of the State s�~ Highway iiystem, which has heretofore been designated as Loop 289 by the State Highway Commission; and, WHEREAS', under the terms of t e contract the procurement and acquisition t ofithe 'necetsary land needed for road right of way purposes is the obligation o€ the City of Lubbock; and, WHEREAS, the State Highway Commission has deemed it necessary in order to 'lmake certain highway improvements in connection with said hLoop 289" situated in and adjacent to the City of Lubbock and to the end that this purpose be accomplished, the necessity of which is hereby confirmed by ,the City `dommission of the City of Lubbock, it is necessary that fee simple title to the land hereinafter described be acquired by the City of Lubbock'in fulfillment and satisfaction of its contractual obligations to the State of Texas; and, _ WHEREAS F. C. Scott own or have some character interest in land needed for the location, construc- tion and maintenance of said Loop 289, and the value and total damages" to the owners for the fee simple title to said land have been appraised in the amount of $ 4,48? and the Commission finds said amount to be :fair NOW THEREFORE and `equitable; BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: THAT the fee simple title to the following described land situated in Lubbock County, Texas, be acquired by the City of Lubbock for and on tehalf of the State of Texas for the purpose of opening, constructing and maintaining in conjunction.,with the State Highway Commission, said "Loop 289" asA ,. designated part of the State Highway System, which land If more particularly described as follows: 0.281 of one acre, same being out of and a part of that certain 0.538 acre tract in Section 15, Block A, Lubbock County, Texas, which 0.538, acre tract tas conveyed_ �o F.--C. ` Pcott by deed dated 7 July 151, of record in vol. 422, page 605, Deed Records of Lubbock County, Texas, which 0.281 of one acre is more particularly described by metes and bounds as follows: BEGINNIWG at the-'northwest corner of said 0.538 acre tract, said corner being 3750.3 feet east and 683.5 feet south of the northwest corner of said Section 15; THENCE South 89°55t E, 153.7 feet along the north boundary line of said 0.538 acre tract, to a point; THENCE S 36013' W, 96.8 feet to :a point in the south boundary line of said 0.538 acre tract; THENCE N 89°55t Vilest, 159.0 feet along said south boundary line to the southwest corner of said 0.538 acre tract; THENCE N 38*41' E, 100.0 feet to the place of beginning. THAT the owners of said land be offered, through the Right of Way Depart- ment, the amount appraised as the value and total damages for the fee simple title .and acquisition of said land for the purposes herein stated, for the use and benefit of the City of Lubbock and State of Texas, and unless accepted forthwith the City Attorney is hereby authorized and instructed to institute condemnation proceedings to acquire the fee simple title to said land as hereinabove described for highway purposes.
