WHEREAS, the City of Lubbock and the State of Texas, by and through.
the State Highway Commission, have entered into a contract as empowered
and authorized by Art. 6673-b, Vernon's Annotated Civil Statutes, providing
for the location, construction and maintenance of that part of the State Highway'
. t system, which has heretofore been designated as Loop 289 by the State High-

way Commission; and,
WHEREAS, under the terms of the contract the procurement and acquisition
of the necessary land needed for road right of way purposes is the obligation of th
City of Lubbock; and,
WHEREAS, the State Highway Commission has deemed it necessary in orde
to make certain highway improvements in connection with said "Loop 28911 situate
in and adjacent to the City of Lubbock and to the end that this purpose be accom-
plished, the necessity of which is hereby confirmed by the City Commission of
the 'City of Lubbock, it is necessary that fee simple title to the land hereinafter
described be acquired by the City of Lubbock in fulfillment and satisfaction of
its contractual obligations to the State of Texas; and,
WHEREAS W. A. Maddox
own or .have some character intere st"iaz:.land needed for the location, construction
and maintenance of said Loop 289, and the value and total damages to the owners
for the fee simple title to said land have been appraised in the amount of
$10L 410 _' __ and the Commission finds said amount to be fair and

equitable, NOW THEREFORE:
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:'
THAT the fee simple title to the following described land situated 'in Lub-
bock County, Texas, be acquired by .the City of Lubbock for and on behalf of
the State of Texas for the purpose of opening, constructing and maintaining in
conjunction with the State Highway Commission, said "Loop 289" as a designated
part of the State Highway System, which land is more particularly described
as follows:
Nine parcels of land out of Lots 1-18, Block 4, Riverlawn Addition to the
City of Lubbock, conveyed to W. A. Maddox by deed dated 28 Mar. 147, and
recorded in vol. 338, page 562 of the deed records of Lubbock County, Texas,
and being more particularly described as follows:
PARCEL 252: All of said Lot 18 and contains 0.565.
PARCEL 252A: All of said Lot 17 and contains 0.603 acres.
PARCEL 252B: Beginning at the northeast corner of said Lot 16; thence S
3*12' W, 22.0 feet along the southeast boundary line of said Lot 16, to a
point; thence N 72*03' W, 101.2 feet, to a point; thence N 77a16i W, 146.7
eet, to a point in the northwest boundary line of said Lot 16; thence in a
northerly direction along a circular curve to the left, the center of the
curve being N 51*43, W,' 575 feet from the beginning of this call, a distance
of 85.8 feet, to the northwestcorner of said Lot 16; thence S 60°16' E,
34.2 feet to the place of beginning and contains 0.271 acres.

6*41, E, 65.8 feet along the west boundary line of said Lot 2, to a point;
thence N 89040, E, 236.2 feet, to a point in the east boundary line of

to the southeast corner of said Lot 2; thence N 87*14' W, 240.3 . feet along
the south boundary line of said Lot 2, to the place of beginning and con-
tains 0.393 acres.
PARCEL 252D: All of said Lot 3 and -contains 0.560 acres.
PARCEL 252E: All of said Lot 4 and contains 0.562 acres.
PARCEL 252F: All of said Lot 5 and contains 0.559 acres.
PARCEL 252G: Beginning at the northeast corner of said Lot 6; thence in a
southeasterly direction along a circular curve to the right, the center of
the curve being N 59*31' W, 425 feet from the beginning of this call, a
distance of 35.4 feet along the southeast boundary line of said Lot 6, to
a point; thence N 72*03' W, 240 feet, to a point in the southwesterly
boundary line of said Lot 6; thence N 48954, W, 31.7 feet along said south-
westerly boundary line to the western most corner of said Lot 6; thence N
33012' E, 82.2 feet to the place of beginning and contains 0.428 acres
PARCEL 252H: Beginning at the northern most corner of said Lot 7; thence
S 48*54' E, 31.7 feet alongthe northeast boundary line of said Lot 79 to a
point; thence N 72*03' W, 32.6 feet, to a point in- the northwest boundary
line of said Lot 7; thence N 33*12' E, 12.9 feet to the place of beginning
and contains 0.005 acres.
THAT the owners of said land be offered, through the Right of Way Depart-
ment, the amount appraised as the value and total damages for the fee simple
title and acquisition of said land-for the purposes herein stated, for the use and
benefit of the City of Lubbock and State of Texas, and unless accepted forthwith
,the City Attorney is hereby authorized and instructed to institute condemnation
:proceedings to acquire the fee simple title to said land as hereinabove described
for highway purposes.
