M. machines in the Water and Light Department has displaced old Burroughs Bookkeeping and Posting 4 machines which have been stored and are of no further use to the City and it is the desire of the City not to permit this equipment to become obsolete but to salvage whatever value they have at the earliest possible date; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE .CITY OF LUBBOCK: The City Manager is hereby authorized and directed to sell or cause to be sold any and all obsolete or displaced Burroughs Bookkeeping and Posting Machines ordinarily used in the Water and Light Department at the best obtainable price with or without bids and all payments for such machines so sold shall be paid into the general fund. Passed by unanimous vote of the City Commission this 14th day of March, 1957. Wilson, City Attorney SUBJECT: Sale of Replaced and Used Burroughs Bookkeeping,and'posting Machines You have requested an opinion stating what procedure must be followed in connection, with the sale of City property of the character above mentioned. There is no present statute or charter or ordinance provision regulating such sales. In 1949 the City Commission passed a Resolution authorizing the City Manager to sell or cause to be sold unusable or obsolete equip- ment after receiving sealed competitive bids and accepting the best obtainable price therefor based on such bids. This is the only regula- tion known to this department governing such sales. Due to the fact that the memo and information connected therewith indicates that a sale may be immediately made of one machine at what is considered a fair price., it may be possible that the Commission would authorize the sale of the items listed on the memo of February 8, 1957, in the Water and Light Department under a different Resolution, and assuming that this is desirable, I am attaching to this memo a Resolution to be submitted to the ity lion n the Of xs Moab. v- V�GE.
