HomeMy WebLinkAboutResolution - 032857B - Street Improvements - West Texas Construction Inc - GWO 2068 - 03_28_1957 Y GWO 2068 5� RESOLUTION 2� RESOLUTION APPROVING AND ADOPTING ESTIMATE OF THE COST OF IMPROVE- MENTS, OF ANDUPTS TO BE ASSESSED FOR IMPROVEI11ENTS IN THE NATURE OF GRADING, LAYING CURB AND GUTTER ARID PAVING PORTIONS OF CERTAIN STREETS, HIGHWAYS, AVENUES AND/OR ALLEYS IN THE CITY OF LUBBOCK, TEXAS AND CERTAIN STREETS AND HIGHWAYS, AVENUES AND/OR ALLEYS ALONG THE BOUNDARY OF SAID CITY, SAID IMPROVE- PM'TS BEING DESIGNATED AS GWO NO. 2068, FIXING THE TIME AND PLACE FOR A HEARING TO THE OWNERS OF ABUTTING PROPERTY, AND OTHER PERSONS INTERESTED IN SAID PROP- ERTY AND DIRECTING THE CITY SECRETARY TO PUBLISH NOTICE ON BEHALF OF THE GOVERNING.BODY OF THE CITY OF LUEBOC4; TEXAS. WHEREAS, the Governing Body of the City of Lubbock has heretofore ordered that portions of the streets, highways, avenues and/or alleys be im- proved by grading, installing concrete curb and gutter and paving with caliche base and quadruple asphalt surface together with incidentals and appurtenances and arrangements therefore have been made and entered into by the City of Lubbock, Texas with West Texas Construction, Incorporated, Contractor, and, WHEREAS, the Governing Body of the City of Lubbock has caused the City Engineer to prepare and file estimates of the cost of such improvements and estimates of the amounts per front foot to be assessed against abutting property and the owners thereof, and such estimates have been prepared and examined; THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK, TEXAS I. Such estimates be and they ere hereby adopted and approved. II. NOTICE TO THE OWNERS OF PROPERTY ABUTTING UPON THE HEREINBELOW MENTIONED PORTIONS OF STRUTS, HIGHWAYS, AVENUES AND/OR ALLEYS AND TO ALL OTHERS AFFECTED The Governing Body of the City of Lubbock has heretofore ordered that the following portions of streets, highways, avenues and/or alleys in and along the boundary of the said City of 'Lubbock,. Texas, be improved by raising, gradin and filling and installing concrete curbs and gutters and storm sewers and drains where necessary on streets, highways, avenues and/or alleys, designated below: All thirty (30) foot width streets, known and designated as Unit Number 1879, the total estimated cost of improvements is 47,686.24; the estimated amount per front foot to be assessed against the abutting property and owners .thereof for property owner curb and gutter is $1.5225; the estimate amount per front foot to be assessed against the abutting property and owners thereof for improvements exclusive of property owner curb and gutter is $2.391035 for front abutting property and $1.594023 for side abutting property; said thirty (30) foot width streets are specifically set forth as the following Sub-Units of Unit 1879: 03208sia SUB-UNIT STREW FROM TO 1 Uvalde Avenue SPL 3 9th Street NPL 40th Street 2 Detroit Avenue SGL 1st Street NGL let Place 3 20th Street EGL Avenue M WGL Avenue L 4 Avenue W SPL alley S. of NPL 50th Street 49th Street(E.Leg) All thirty-six (36) foot width streets, known and designated as Unit Number 1880, the total estimated cost of improvements is 6206,531.04; the estimated amount per front foot to be assessed against the abutting property and owners thereof for property owner curb and gutter is $1.5225; the estimated amount per front foot to be assessed against the abutting property and owners thereof for improvements exclusive of property owner curb and gutter is 3.338949 for front abutting property and $2.225966 for side abutting property; When a thirty-six (36) foot street is adjacent to property owned by he Lubbock Independent School District, the width shall be increased six (6) eet on the school side and the total estimated amount per front foot to be assessed against the School District is C4.472911 for front abutting property including the extra six (6) feet of with and exclusive of curb and gutter, said thirty-six (36) foot width streets are specifically set forth on the following Sub-Units of Unit 1880: UB-UNIT °SET TO 1 Kemper Street WPL Avenue Q North WPL N. Quirt Avenue 2 5th Street 106.75r W.WPL Ave. 0 WPL Ave. 0 Seventy-two (72) foot width street, known and designated as Sub-Unit 1 of Unit 1884, the total estimated cost of the improvement,1t'68,319.86; the estimated amount per front foot to be charged against the abutting property and owners thereof for property owner curb and gutter is 01.5225; the estimated amount per front foot to be charged against the abutting property and the owners thereof for improvements exclusive of property owner curb and gutter is $3.338949 for front abutting property and $2.225966 for side abutting property; said seventy-two (72) foot width street is specifically set forth as the following Sub-Unit 1 of Unit 1884: SUB-UNIT STREET FROM TO 1 Indiana Avenue SPL alley S.of 48th 55t N. of C.L.50th Street Street r— All fifteen '(15) foot width alleys, known and designated as Unit A-311; the total estimated cost of improvements is $13,146.89; the estimated amount per foot to be assessed against the abutting business property and owners thereof for improvements is 3.318593; the estimated amount per foot to be assessed against the abutting residential property and owners thereof for improvements is 41.259893; the total estimated cost to be assessed against the railway company for paving improvements between the rails and two feet on each side thereof is $4500.00; the estimated amount per linear foot to be assessed against the railroad trackage and the owners thereof for improvements is 025.00; said fifteen (15) foot width alleys are specifically set forth as the following Sub-Units of Unit A-311: L'B-UNIT 1 Alley between Avenue S and College Avenue and between 19th Street and 20th Street 2 E.-W alley between Broadway and 13th Street and Avenue E and Avenue F 3 Alley in Block 1, Palace Heights 4 Alley between 34th Street and 35th Street and between Avenue % & College Avenue All twenty (20) foot width alleys, known and designated as Unit A-312; the total estimated cost of improvements is $12,165.44; the estimated amount per foot to be assessed against the abutting business property and owners thereof for improvements is $4.581232; the estimated amount per foot to �^ be assessed against the abutting residential property and owners for improve- ments Is $1.259893; said twenty (20) foot alleys are specifically set forth as the following Sub Units of Unit A-312: SUB-UNIT 1 Alley between Avenue W and Avenue % and between 18th Street and 19th Street 2 Alley between 32nd Street and 33rd Street and Avenue U and Avenue V 3 Alley between 33rd Street and 34th_Street and Avenue U and Avenue V And arrangement for the mi%king and construction of such improvements - with pavement of quadruple course asphalt surface treatment (Inverted Penetra- tion Type) and a Six (6) Inch compacted caliche base in streets, highways, avenues and/or alleys and with pavement of Five (5) Inch concrete slab in alley has been made and entered into by the City of Lubbock, Texas, and rolls or statements showing the proposed amounts to be assessed against abutting proper- ty and the owners thereof have been filed with the ity, such rolls or state- ments showing other matters and things, and have been approved and the ity Commission of said City has fixed a tLme and place for hearing to the owners of property abutting upon said portions of streets, highways, avenues and/or alley , and to all others,-affected .0 at which hearing the amounts to be assessed against the respective parcels of abutting land and the owners thereof for improvements in the Sub-Units upon which 'the particular parcels of property abut, the amounts of benefits to the respective parcels of property by means of the improvements in the Sub-Unit upon which the particular property abuts, the regularity of the proceedings with reference to such improvements, the apportionment of the cost of such improvements, and other matters and things will be determined, and after such hearings assessments will by ordinance be a 0320S 7 made and levied, and such hearing will be had and held by and before the City Commission of the City of Lubbock, Texas, in regular Commission meeting room in the City Hall, in the City of Lubbock, Texas on the llth day of April 1957, at 2:00 P.M. o1clock. The rolls or statements showing the proposed amounts of such assessments are on file in the office'of the City Secretary and copies thereof are in the office of the City Engineer of the City of Lubbock and open to inspection of any interested parties at any time, and of all said matters and things all such owners of property., as well as any and others in anywise affected or interested, will take due notice. By order of the City Commission of the City of Lubbock, this the 28th day of March 1957. No notice other than that hereinabove provided for shall be necessary but publication of such notice shall be due and sufficient notice to a y and all persons, firms, corporations and other parties. III. That a hearing be given and held by and before the Governing Body of the City of Lubbock, Texas, to all persons owning or claiming amy property abutting any part or portion of said streets, highways, avenues and/or alleys described in Section II, of this Resolution, as well as all owning or claiming any interest in any such property. such hearing shall be given and held on the ,•— llth day of April 1957, at 2:O9 P.M. otclock on the first floor in the City Hall, City of Lu'cbock.. Texas and the City Secretary is hereby directed to give notice of the time and place of such hearing, and of other matters and facts in accordance with the terms and provisions of an Act passed at the first called session of the 40th Legislature of the state of Texas and known as Chapter 106 of the Acts of said Legislature which has been adopted as an amendment to and made a part of the Charter of the City of Lubbock, Texas, and as amended by Chapter 281 Acts of the '52nd Regular Session of said Legislature. Such notice shall be by advertisement inserted at least three times in a newspaper published in the ity of Lubbock, Texas; the first publication.shall be made at least ten days before the said hearing. Said notice shall comply with and be in accordance with the terms and provisions of this resolution and said Act as amended.
