WHEREAS, the City of Lubbock and the State of Texas, b and through;

the State Highway Commission, hhve entered into a contract as: empowered
and authorized by Art. 6673-b, Vernon's Annotated Civil Statutes, providing
for the location, construction and maintenance of that part of the State Highway
system, which has heretofore been designated as Loop 289 by the State High-
way Commission; and,
WHEREAS, under the terms, of the contract the procurement and acquisition
of the necessary land needed for road right of way purposes.is the obligation of th
City of Lubbock; and,
WHEREAS, the State Highway Commission has deemed it .necessary in ordeil
to make certain highway improvements in connection with`said "Loop 289" situate
in and adjacent to'the City of Lubbock and to the end.that this purpose be accom-
plished, the necessity of which is hereby confirmed by the City. Commission of
the City of Lubbock, it is necessary that fee simple title to the land hereinafter
described be acquired by the City of Lubbock in fulfillment and satisfaction of
its contractual obligations to the State of Texas; and,
WHEREAS 0. A. Webb and J. H. Adams
own or:have some character inter est.in'.land needed for the location,: construction
and maintenance of said Loop 289, and the value and total damages to the owners
for the fee simple title to said land have been appraised in the amount of
and the Commission finds said amount to be fair and
equitable; NOW THEREFORE
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:'
THAT the fee simple title to the following described land situated ;in Lub-
bock 'County, Texas, be acquired by the City of Lubbock for and on behalf of
the State of Texas for the purpose of opening, construe ' nn m4intaining in
conjunction with the State Highway Commission, said as a-designated
part of the State Highway System, which land is more particularly described
as follows: 0.040 of one acre of land, being a strip of land 10 feet in
width lying parallel to the present right-of-way line extending from. the
east property line to the west property line and being a part of Lots 1
through 7, Block 2, were conveyed to 0. A. Webb by a deed dated 28 January
1952, of record in volume 500, page 453, Deed Records of Lubbock County,
Texas, which 0.040 of one acre is more particularly described by metes
and bounds as follows: 11arlin Park Addition
BEGINI}LING at the northeast corner of Lot 1, Block 2;
THENCE S 33-111 W, 10 feet along the east boundary line of said Lot l,to a
point;
THENCE N 56e49t W, parallel to the present centerline of US Hwy. 84, 175.01 ;
THE 4CE N 33011' E, 10 feet;
THENCE S 56°49t E, 175.0 feet to the place of beginning.
Also
0.006 of one acre of land, being a strip of land 10 feet in cidth lying
parallel to the present right-of-way line extending from the east property
line to the west property line and being a part of Lot u, Block 2, Marlin
Park Addition to the City of Lubbock, Texas, according to a plat recorded
in vol. 414, page 617, Deed Records of Lubbock County, Texas, which Lot 8,
Block 2., was conveyed to Harold. M. Alschuler by a deed dated 25 June '52,
of record in vol. 476, page 517, Deed Records of Lubbock County, Texas,
which 0.006 of one acre is more particularly described by metes and bounds
as follows:
BEGINNING at the northeast corner of Lot 8, Block 2;
THENCE S 33*11' Vl, 10 feet along the east boundary line of said Lot 8, to
a point;
THENCE N 56049' Vd, parallel to the present centerline of US Hwy. 84, 25' ;
THENCE N 33*11' E, 10 feet;
IL231;E .S 56°49' E, 25 feet to the glace of beginning.
THAT the owners of said land be offered, through the Right of Way Dep.'Lrt-
ment, the amount appraised as the value and total damages for the fee simple
title and acquisition of .said land for the purposes herein stated, for the use and
benefit of the City of Lubbock and State of 'Texas, and unless accepted forthwith
the City Attorney is hereby authorized and instructed to institute condemnation
proceedings to acquire the fee simple title to said land as hereinabove described
for highway purposes.
