State of Texas, by andthrough: the State Highway Commission; lave entered into a contract as empowered and authorized by Art. 6673-b: Vernon's Annotated Civil Statutes, providing for the location, construction and maintenance -of that part,of the State Highway ,n system, which has heretofore 'been designated as Loop Z89 by the State High-'. way Commission; and, 4� •. WHEREAS, under the terms of the contract the p Qcurerrient and acquieitio of the necessary land needed for road right of way purposes is the obligation of th City of Lubbock; and, WHEREAS. the State Highway Commission has deemed it necessary in orde to make certain highway improvements in connection with said "Loop 289" situate in and adjacent to'the. City of Lubbock and to the end.that this purpose be accom- plished, the necessity of which is.hereby confirmed by the City Commission of the City of Lubbock, it is necessary that fee simple title to the -land hereinafter described be acquired by the City of Lubbock in fulfillment and satisfaction of its contractual obligations to the State of Texas; and, WHEREAS R. E. L. Pattillo and wife Anna .Hanna Pattillo r own.or:have some character inter e at'.,#n.land needed for the location,: construction and maintenance of said Loop 289; and the value and total damages• to, the owners for-the fee simple title to said land have been appraised in the amount of $ and the `Commission finds said arriount to be fair and equitable; NOW THEREFORE: BE IT RESOLVED BY THE CITY COMMISSION OF THE ,CITY OF LUBBOCK.' THAT the fee simple title to the following described land��a#tuited;In- Lub- bock County, Texas, be acquired by the City of Lubbock for and on behalf' of the =State of Texas for the purpose of opening, constructing and maintaining-in conjunction with the State Highway Commission, said "Loop 28911 as a designated part .of the State Highway System, which land is more -particularly described as follows: TRIX T 1 Beginning at the point of intersection of the East right-of-way line of the present highway and the North boundary line of Section 10, said point is 60 feet East of the Northwest corner of Section 10; Thence S 89058, E, 129.6 feet to a point on a curve, said point is N 23'37' Ill, 215 feet from the center of said curve; Thence Southerly along said curve to the left, a. distance of 248.9 feet to a point in the East right of way line of the present highway; Thence N 0*04, W, 197.1 feet to the place of beginning and containing 0.168 acres. TRACT 2 Beginning at a point in the North boundary line of Section 10,skid point is 384.0 feet East of the Northwest corner of Section 10; Thence East 936.0 feet; Thence South 259.5 feet; Thence 13 72103' W, 561,8 feet; Thence N 77946, w, 410.7 feet to the place of beginning and contains 2.531 acres making a total of 2.699 acres being conveyed by this instruuent. t �l THAT the owners of said land be offered, through the Right of Way Depart- ment, the amount appraised as the value and total damages for the fee simple title and acquisition of said land for the purposes herein stated, for the use and benefit of,the City of Lubbock and 'State of Texas, and unless accepted forthwith the City Attorney is hereby authorized and instructed to institute condemnation proceedings to acquire the fee simple title to said land as hereinabove described for highway purposes.
