RESOLUTION
WHEREAS, the City of Lubbock did on or about December 26, 1953, acquire
the .water rights in and under League No. 2,06 situated in Lamb and Bailey County,,
Texas, and has further acquired such water and water rights in approximately
53, 000 acres of land situated in the sandhills located in Bailey County, Texas; and,
a WHEREAS, the City of Lubbock is a city with a population in excess of
130, 000 people; and,
rt� WHEREAS., on May 25, 1953, the City of Lubbock let a contract to James W.
iller, D.B.A.. A. and A. Gonstruction.Company providing for the construction
f a pipeline from League No. 206 situated in Lamb and Bailey County, Texas, to
onnect with another part of the water system of the City of Lubbock in Lubbock
o unty, Texas; and,
WHEREAS, the City Commission finds that it is necessary for the City of
1.ubbock to construct said pipeline in accordance with the contract with James W.
tiler and to acquire such rights of way for such pipeline as may be required to
arty out said contract; NOW, THEREFORE,

The City Commission of the City of Lubbock finds:
(1) THAT the water rights in League No. 206 situated in Lamb and
Bailey County, Texas, and that the approximate 53, 000 acres
in the sandhills in Bailey County, Texas, are owned by the City
of Lubbock and are a part .of the City water supply system.
(2) THAT it is necessary that water produced from wells located
on the lands above described be transported to the:City of
Lubbock for use by its inhabitants and for domestic''consumption,
and sanitation and fire protection.
(3) THAT in order to efficiently and economically transport the
water from the well sites to a point of connection with the
present water system of the City of Lubbock, it is deemed
necessary for the City of Lubbock to construct the pipeline
from said well sites to a point of connection with the water
system of the City of Lubbock over, across, and through such
lands as may have to be transversed by such pipeline.
(4) THAT heretofore and prior to August 1, 1956, the City Com-
mission found the above and foregoing facts and authorized the
City Attorney to file such condemnation proceedings and/or
cross actions in suits filed against the City, to acquire by
condemnation the right of way for such water lines; NOW,
THEREFORE,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
THAT the City Attorneys action in heretofore filing any condemnation suits
r cross actions for condemnation in suits against the City for such right of way ,
E in all things hereby ratified and confirmed and BE it further resolved by the
ity Commission of the City of Lubbock that the City Attorney is further authorized
o acquire by condemnation or to file cross actions for condemnation in suits filed,
gainst the City affecting the construction of said waterline.
