RESOLUTION APPROVING AND ADOPTING ESTIMt1TE OF THE COST OF IMPROVDUTS OF AMOUNTS TO BE ASSESSED FOR IMPROVEKSaITS IN THE NATURE OF GRADING, LAYING CURB AND GUTTER, PAVING PORTIONS OF CERTAIN STR&''TS, HIGKIAYS AND AVENUES IN THE CITY OF LUBBOCK, TEXAS AND CERTAIN STREETS AND HIGZ6AYS AND AVEIIUES ALONG THE BOUNDARY OF SAID CITY, SAID IMPROVFM124TS BEING DESIGNATED AS CwO NO. 20151 FIXING THE TIME AND PLACE FOR A HEARING TO THE Ual-ERS OF ABUTTING PROPERTY, AND OTHER PERSONS INTERESTED IN SAID PROPERTY AND DIRECTING THE CITY SECRETARY TO PUBLISH NOTICE ON BEHALF OF THE GOVERNING BODY OF THE CITY OF LUBBOCK, TEXAS. WHEREAS, the Governing Body of the City of Lubbock has heretofore ordered that portions of the streets, highways and avenues be improved by grading, installing concrete curb and gutter and paving with caliche base and quadruple asphalt surface together with incidentals and appurtenances and arrangements therefore have been made and entered intoNthe City of Lubbock, Texas with Elliott Taylor, Paving Contractor, arid., WHEREAS., the Governing Body of the City of Lubbock has caused the City Engineer to prepare and file estimates of the cost of such improvements and estimates of the amounts per front foot to be assessed against abutting property and the owners thereof., and such estimates have been prepared and examined; ^ THEREFORE, BE IT RESOLVED BY THE; CITY COMDaSSION OF THE CITY OF LUBBOCK, TEXAS I. Such estimates be and they are hereby adopted and approved. II. NOTICE TO THE OWNERS OF PROPERTY ABUTTING UPON THE HERSINBELOW K&TIONED PORTIONS OF STREETS, HIGItIAYS, AVENUES AND/OR ALLEYS AND TO ALL OTHERS AFFECTED: The Governing Body of the City of Lubbock has heretofore ordered that the following portions of streets, highways and avenues in and along the boundary of the said City of Lubbock, Texas,, be improved by raising, grading,, and fil]in and installing curbs and gutters, storm sewers and drains where necessary on streets, highways and avenues,, designated below: It is hereby found and determined that the cost of improvements on such portions of said streets, avenues and highways with the amount or amounts per front foot proposed to be assessed for such improvements against the abutting property and the owners thereof, on the portions of said streets, avenues and highways are as follows, to wit: a :K i All thirty (30) foot width streets, known and designated as Unit Number 1864, the total estimated cost of improvements is �7,104.03; the estimated amount per front foot to be assessed against the abutting property and owners thereof for property owner curb is 01,575; the estimated amount per front foot to be assessed against the abutting property and owners thereof for improvement exclusive of property owner curb is 42.5360129 for front abutting property and $1.6906753 for side abutting property; said thirty (30) foot width streets are specifically set forth as the following Sub-Units of Unit 1864: SUB-UNIT STREET FROM TO 1 Louisville Avenue SPL 37th Street NFL 38th Street 2 Avenue L NGL 37th Street NFL 38th Street 3 22nd Street WPL Avenue J EPL Avenue K All thirty-six (36) foot width streets, known and designated as Unit Number 1865, the total estimated cost of improvements is 4217,364.12; the estimated amount per front foot to be assessed against the abutting property and owners thereof for property owner curb is �1.575; the estimated amount per front foot to be assessed against the abutting property and owners thereof for improvements exclusive of property owner curb is �2.8778168 for front abutting property and $1.9185445 for side abutting property, the estimated amount to be assessed against the Panhandle and Santa Fe Railway Company and their crossings for the paving improvements between the rails and two feet each side thereof is $145.39; the estimated amount to be assessed against the Fort'. Worth and Denver City Railway Company and its crossings for the paving im- provements between the rails and two feet each side thereof is �492.57, said thirty-six (36) foot width streets are specifically set forth as the following Sub-Units of Unit 1865. Erskine St. NFL Marshall Street ow All seventy-two (72) foot width streets known and designated as Unit Number 1868, the total estimated cost of improvements is 07,598.62; the estimated amount per front foot to be assessed against the abutting property and owners thereof for property owner curb is U.575; the estimated amount per front foot to be assessed against the abutting property and owners thereof for improvements exclusive of property owner curb t2.8778168 for front abutting property and �1.9185445 for side abutting property in residential zones and $4.5325145 for front abutting property in other zones or property in residential zones with non-conforming usage; said seventy-two (72) foot width streets are specifically set forth as the following Sub-Unit of Unit 1868: SUB-UNIT STREET FROM TO 1 34th Street WPL Quaker Avenue WTL Utica Avenue And arrangement for the making and construction of such improvements with pavement of quadru le course asphalt surface treatment (Inverted Penetration Type) and a Six (6� Inch comp;;.cted caliche base in, streets, highways, avenues and/or alleys and with pavement of Five (5) Inch concrete slab in alleys has been made and entered into by the City of Lubbock, Texas and rolls or state- ments showing the proposed amounts to be assessed against abutting property and the owners thereof have been filed with the City, such rolls or statements showing other matters and things, and have been approved and the City Commissio of said City has fixed a time and place for hearing to the owners of property abutting upon,:said portions of streets, highways, avenues and/or alleys, and to all others affected, at which hearing the amounts to be assessed against the respective parcels of abutting land and the owners thereof for improvements in the units upon which the particular parcels of property abut, the amounts of benefits to the respective parcels of property by means of the improvements in the unit upon which the particular property abuts, the regularity of the proceedings with reference to such improvements, the apportionment of the cost of such improvements, and other matters and things will be determined, and afte such hearings assessments will by ordinance be made and levied, and such heari will be had and held by and before the City Commission of the City of Lubbock, Texas, in regular Commission meeting room in the City Hall, in the City of Lubbock, Texas on the 23rd day of August, 1956, at 2:30 P.M. o'clock. The roll or statements showing the proposed amounts of such assessments are on file in the office of the City Secretary and copies thereof are in the office of the City Engineer of the City of Lubbock and open to inspection of any interested parties at any time, and of all said matters and things all such owners of property, as well as any and others in anywise affected or interested, will take due notice. By order of the City Commission of the City of Lubbock, this the 9t h day of Augus t , 1956. No notice other than that hereinabove provided for shall be necessary but publication of such notice shall be due and. 6ufficient notice to any and all persons, firms, corporations and other parties. III. That a hearing be given and held by and before the Governing Body of the City of Lubbock, Texas, to all persons owning or claiming any property abutting any part or portion of said streets' highways, avenues and/or alleys described in Section II, of this Resolution, as well as all owning or claiming any interest in any such property. Such hearing shall be given and held on the 23rd day of August, 1956, at 2:30 P.M. o'clock on the first floor in the City Hall, City of Lubbock, Texas and the City Secretary is hereby directed to give notice of the time and place of such hearing, and of other matters and facts in accordance with the terms and provisions of an Act passed at the first called session of the 40th Legislature of the State of Texas and known as Chapter 106 of the Acts of said Legislature which has been adopted as an amendment to and made a part of the Charter of the City of Lubbock, Texas, and as amended by Chapter 281 Acts of the 52nd Regular Session of said Legislature. Such notice shall be by advertisement inserted at least three times in a news— paper published in the City of Lubbock, Texas; the first publication shall be made at least ten days before the said hearing. Said notice shall comply with and be in accordance with the terms &nd provisions of this resolution and said Act as amended.
