HomeMy WebLinkAboutResolution - 072656B - Legal Proceedings In Condemnation - Croslin & Pharr - Runway Clear Zones Airport - 07/26/1956 67Z( RESOLUTION WHEREAS, the City Commission of the City of Lubbock, Texas did, by resolution dated.October 20, 1955, as amended by resolution dated April 21, 1956, determine that certain runway clear zones were essential for the continued operation of the Lubbock Municipal Airport, were- required for the Public Convenience and Necessity and were required for the preserva- tion of the public safety of the users and the neighbors of the Lubbock Munici- pal Airport, and WHEREAS, the right of way agent of the City of Lubbock, Texas has secured appraisals of the land tracts involved, and WHEREAS, the Airport Board of the City of Lubbock, has made recommendation that the appraisal of the Lubbock Real Estate Board is a fair and reasonable appraisal of the value of such property, and WHEREAS, the City Commission of the City of Lubbock has authorized formal offers to be made to the land owners of the land tracts involved, based on the fair and reasonable appraisal of the value of such properties, and WHEREAS, formal offers have been made by authorized representa- tives of the City of Lubbock to all those known to have or claim an interest in the land hereinafter described and such offers have not been accepted by those to whom such offers were made; NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE. CITY OF LUBBOCK, TEXAS THAT: The special attorneys for the City of Lubbock, Croslin & Pharr, are hereby authorized and directed to institute proper legal proceedings in condemnation in the name of and for and on behalf of the City of Lubbock, Texas against Burnette J. Thiel, Clarence P. Thiel, Robert W. Thiel and Sinclair Oil and Refining Company, the owners, and all others known or found to have an interest in the following described tract of land situated in Lubbock County, Texas, to-wit: A tract of land containing 17. 765 acres out of the South 1/2 of Section 36, Block A, Lubbock County, Texas described by metes and bounds as follows: ' COMMENCING at a one inch iron pipe set for the Southwest corner of the Southeast one-quarter of Section 36, Block A, Lubbock County, Texas, for the place of beginning; THENCE East a distance of 121. 4 feet to a point; _ THENCE North a distance of 790. 0 feet to a point; ell- THENCE West a distance of 1, 005. 0 feet to a point; THENCE South a distance of 790. 0 feet to a point; THENCE East a distance of 883. 6 feet to the point of beginning.
