DESIGNATED AS GWO NO. 1234-C, FIXING THE T12M AND PLACE FOR A HEARING TO THE OWNERS OF ABUTTING PAOP RTY, AND OTHER PERSONS INTERESTED IN SAID PROPERTY AND DIRECTING THE CITY SECRETARY TO PUBLISH NOTICE ON BEHALF OF THE GOVERNING BODY OF THE CITY OF LUBBOCK, TEXAS. WHEREAS, the Governing Body of the City of Lubbock has heretofore ordered that portions of the streets, highways, avenues and/or alleys be Im- proved by grading, installing concrete curb and gutter and paving with r.'5Lliche base and quadruple asphalt surface together with incidentals and appurtenances and arrangements therefore have been made and entered into by the City of Lubbock, Texas with J. R. Fanning, Contractor, and, WHEREAS, the Governing Body of the City of Lubbock has caused the City Engineer to prepare and file estimates of the cost of such improvements and estimates of the amounts per front foot to be assessed against abutting property and the owners thereof, and such estimates have been prepared and examined; THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK, TEXAS I. Such estimates be and they are hereby adopted and approved. II. NOTICE TO THE OWNERS OF PROPERTY ABUTTING UPON THE HEREINBELOTJ MENTIONED PORTIONS OF STREETS, HIGHtidAYS, AVENUES AND/OR ALLEYS AND TO ALL OTHERS AFFECTED: The Governing Body of the City of Lubbock has heretofore ordered that the following portions of streets, highways, avenues and/or alleys in and along the boundary of the said City of Lubbock, Texas, be improved by raising, grad— ing and filling and installing concrete curbs and gutters and storm sewers and drains where necessary on streets, highways, avenues and/or alleys,designated below: It is hereby found and determined that the cost of improvements on such portions of said streets, avenues, highways and/or alleys with the amount or amounts per front foot proposed to be assessed for such improvements against the abutting property and the owners thereof, on the portions of said streets, avenues, highways and/or alleys are as follows, to-wit: Peoria Avenue from its intersection with the South Property Line 32nd Street to its intersection with the North Property Line of Alley South of 32nd Street, known and designated as Sub-unit Number 1 of Unit Number 1855, the estimated cost of improvements is 0974.16; the. estimated amount per front foot to be assessed against the abutting property and owners thereof for curb is 11.5225; the estimated amount per front foot to be assessed against the abutting property and owners thereof for improvements exclusive of curb is $2.201303084, for front abutting property and $1.467535389, for side abutting property. 39th Street from its intersection with a point 152.5 feet East of Nashville Avenue to its intersection with the East Property Line of Nashville Avenue, known and designated as Sub unit Number 2 of Unit Number 1855, the estimated cost of improvements is tl,138.03; the estimated amount per front foot to be assessed against the abutting property and owners thereof for curb is f1.5225; the estimated amount per front foot to be assessed against the abutting property and owners thereof for improvements exclusive of curb is t2.201303084, for front abutting property and $1.467535389, for side abutting property. 39th Street from its intersection with the East Gutter Line of Nashville Avenue to its intersection with the East Property Line of Orlando Avenue, known and designated as Sub unit Number 3 of Unit Number 185% the estimated cost of improvements is $5,179.88; the estimated amount per front foot to be assessed against the abutting property and owners thereof for curb is U.5225; the estimated amount per front foot to be assessed against the abutting property and owners thereof for improvements exclusive of curb is l`2.201303084, for from abutting property and $1.467535389, for side abutting property. 24th Street from its intersection with the 'lest Property Line of Avenue T, to its intersection with the East Property Line of alley West of Avenue T, known and designated as Sub unit Number 4. of Unit Number 1855, the estimated cost of improvements is $992.89; the esti_*iated amount per front foot to be assessed against the abutting property and owners thereof for curb is $1.5225; the estimated amount per front foot to be assessed against the abutting property and owners thereof for improvements exclusive of curb is t2.201303084, for front abutting property and $1.4675389, for side abutting.pruerty. The North-South alley in Block 10, Overton Addition between Avenues Q and R and from 13th and 14th Streets, known and designated as Unit No. A-302; the estimated cost of the improvements is $2,887.45; the estimated amount per front foot to be assessed against the abutting property and owners thereof is w3.937436. And arrangement for the making and construction of such improvements with pavement of quadru le course asphalt surface treatment (Inverted Penetra- tion Type) and a Six (6� Inch compacted caliche base in streets, highways, avenues and/or alleys andwith pavement of Five (5) Inch concrete slab in alleys has been made and entered into by the City of Lubbock, Texas, and rolls or statements showing the proposed amounts to be assessed against abutting property and the owners thereof have been filed with the City, such rolls or statements showing other matters and things, and have been approved and the City Commission of said City has fixed a time and place for hearing to the own- ers of property abutting upon said portions of streets, highways, avenues and or alleys, and to all others affected, at which hearing the amounts to be assessed against the respective parcels of abutting land and the owners thereof for improvements in the units upon which the particular parcels of property abut, the amounts of benefits to the respective parcels of property by means of the Improvements in the unit upon which the particular property abuts, the regularity of the proceedings with reference to such improvements, the apportionment of the cost of such improvements, and other matters and things will be determined, and after such hearings assessments will by ordinance be made and levied, and such hearing will be had and held by and before the City Commission of the City of Lubbock, Texas, in regular Commission Meeting Room in the City Hall, in the City of Lubbock, Texas on the 26th day of April, 1956, at 2:30 P.M. o'clock. The rolls or statements showing the proposed amounts of such assessments are on file in the office of the City Secretary and copies thereof are in the office of the City Engineer of the City of Lubbock and open to inspection of any interested parties at any time, and of all said matters and things all such owners of property, as well as any and others in anywise affected or interested, will take due notice. By order of the City Commission of the City of Lubbock, this the 12th day of April, 1956. No notice other than that hereinabove provided for shall be necessary but publication of such notice shall be due and sufficient notice to any -and all persons, firms, corporations and other parties. 04 1 III. That a hearing be given and held by and before the Governing Body of the City of Lubbock, Texas, to all persons owning or claiming any property abutting any part or portion of said streets, highways, avenues and/or alleys described in Section II, of this Resolution, as well as all owning or claiming, any interest in any such property,. Such hearing shall be given and held on the 26th day of April, 1956, at 200 P.M. ofclock on the first floor in the City Hall, City of Lubbock, Texas and the City Secretary is hereby directed to give notice of the til-ne and place of such hearing, and of other matters and facts in accordance with the terms and provisions of an Act passed at the first called session of the l+Oth Legislature of the State of Texas and known as Chapter 106 of the Acts of said Legislature which has been adopted as an amendment to and made a part of the Charter of the City of Lubbock, Texas, and as amended by Chapter 281 Acts of the 52nd Regular Session of said Legisla- ture. Such notice shall be by advertisement inserted at least three times in a newspaper published in the City of Lubbock, Texas; the first publication shall be made at least ten days before the said hearing. Said notice shall comply with and be in accordance with the terms and provisions of this resolu— tion and said Act as amended.
