HomeMy WebLinkAboutResolution - 032256D - Release Of Liens - Paving Unit No. 855 - Jefferson Avenue Addition - 03_22_1956 a. v/ 03-229(a D Completed R E S 0 L U T ION original WHEREAS, the City Commission has heretofore passed Ordinance No. 925 on Release August 11, 1949, such 'instrument being recorded in Volume 393, Page 11, of the sent to Mr. Deed Records of Lubbock,County, Texas, which Ordinance provided for assessments Orville against various properties in the City of Lubbock for street improvement pur- Ald erson, poses and the record of such Ordinance constitutes an apparent lien on certain Paving Dept property in Paving Unit No. 855, covering a part of Adams Avenue (now Boston of City Avenue) from the South Paving Line of 34th Street to the North Paving Line of 3-29-56. 35th Street in the City of Lubbock, such property being Lots 10 and 11, in Block 1 of the Jefferson Avenue Addition to the City of Lubbock, Texas, said Lot 10 being assessed in the name of Albert Dawson in the amount of THREE HUI,IDRED EIGHTY-SIX AND 24/100 (�386.24) DOLLARS, and said Lot 11 being assessed in the name of O. B. 11itchell in the amount of TWO HUNDRED SEVENTY-ONE AND NINETY FIVE/100 (t271.95) DOLLPM; and., WHEREAS, the paving assessments herein mentioned were made through in- advertence and mistake, and Lots 10 and 11, Block 1, of the Jefferson Avenue Addition of the City of Lubbock, Texas., do not in fact abut Adams Avenue (now Boston Avenue) in the City of Lubbock, and should not be affected by any pav- ing assessments made for the improvement of said Adams Avenue; and, WHEREAS, the owner of such property having now requested a Release on such property owned by such individuals, of the lien or apparent lien on said pro- perty above mentioned, created by the Ordinance hereinabove described; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMSSION OF THE CITY OF LUBBOCK: SECTION 1. THAT the Mayor BE, and he is hereby authorized and directed to execute, for and in behalf of the City of Lubbock, a Release of any and all liens, apparent liens or clouds of title shown of record to exist upon that certain hereinafter described property by virtue of Ordinance No. 925, such instrument being recorded in Volume 393, Page 11 of the Deed Records of Lubbock County, Texas, such Release shall be in favor of Elizabeth B. Evans, a widow, her heirs and assigns, and/or the present owners, their. heirs and assigns, as to the following described property located in the City of Lub- bock, Lubbock County, Texas, to-wit: Lots 10 and 11, Block 1, Jefferson Avenue Addition of the City of Lubbock, Texas. SECTION 2. THAT such Release is to contain the provisions that it shall not affect any property or liens not expressly released thereby. Passed by the City Commission on Marc , 956..
