W. 0. 835 for the making and .... wing construction of street improvements on portions of numerous streets and/or avenues in said City including among others the following: 37th Ztreet from its intersection with a line 392.4 feet West of the West Property Line of Avenue B to its intersection with the West Paving Line of Avenue' A, .known and designated as part of Unit No. 1545. AND WHEREAS, the improvements upon the said portions of the above— mentioned street has been inspected and found to have been constructed in accordance with terms of said Contract GWO 835. TEMZF ARE, BE IT RESOLVED BY THE CITY OF LUBBOCK, TEW: I. ,That the improvements on said portions of the abovementioned street be andllthe same are hereby accepted. II. W. 0. 835, and find the improvements -'' on streets and/or avenues, known and designated as part of Unit No. 1545, as listed on the attached finer eatiute and assessment sheens to have been completed in accordance with the plans and specifications, and recommend that you accept improvements on said street, paging the contractor the amount shown on the attaehed consolidated final estimate sheet as due him by the City of Lubbock, and issue assignable certificates against property owners for the respective amounts shown on the final assessment sheets as being due against theme and their respective properties. Middleton do represent to the City of -Lubbock and solemnly swear that I executed s Contract with the City of Lubbock, said Contract being dated December 10,_ 1953_- for street Paving under General Work Order No. s35 ,, and that the work and contract has been completed according to the plans and spegif°ipar tions pertaining to the project and that all labor, material, supplies and other cost including equipment, rental and hire, and all expense, items incurred in connection with said project have been paid in ful.l; that all liens and rights to fix liens against any part of said project or the moneys, bonds, or warrants due the Contractor, have been satisfied by payment to the claimant, his authorized agent or attorney, and full release of all recorded liens or claims have been, secured by settlement and duly filed of record with the County Clerk of Lubbock County. I further represent and affirm that all Federal, State and Municipal laws were substantially complied with by me in doing and carrying out the jab and project herein referred to and that I paid applicable scale of wages, andthis affidavit is made to secure payment from, the City of Lubbock to me of the full and final moneys due me under this contract.
