OSZ2 RESOLUTION A RESOLUTION AUTHORIZING THE:MAYOR TO EXECUTE AND DE- LIVER TO A. J. RICHARDSON A WARRANTY DEED .ON BEHALF OF THE CITY OF 'LUBBOCK UBBOCK TO A. J. RICHAR DSON A WARRANTY DEED ON BE- HALF OF THE. CITY OF LUBBOCK TO THE EAST PORTION OF LOT 19 AND THE EAST PORTION OF THE SOUTH HALF OF LOT 20 IN BLOCK 31, OF THE ,EASLEY SUBDIVISION TO THE CITY OF LUBBOCK, MORE PAR- TICULARLY .DESCRIBED BY METES AND BOUNDS IN,THE BODY OF THIS RESOLUTION. WHEREAS, -than part and portion of Lots 19 and .20, Block 31, .Easley Sub- division of the City :of Lubbock, more particularly described hereinafter, is not being used and will not in the future be used or needed for any public purpose; and, WHEREAS, said. lands are excess lands and, have never been used or dedicated to the public use in any manner or impressed with any public easement; and, WHEREAS, A. J. Richardson, who owns the lands ad3acent to said par- tions of said lots, has offered to purchase the same for the sum of $1, 224.00, with the understanding that access rights from such property to the freeway are to be excluded; and, WHEREAS, the City Commission finds that it would be to the public in- terest to sell and,convey said land to said.A. J. Richardson for the consid- eration above stated; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. That the Mayor BE, and he is hereby authorized and di- rected to execute oa behalf of the City of Lubbock, a warranty deed convey- ing to A. J. Richardson of Lubbock County, Texas, the following described property: Being an East portion of Lot 19 and an .East portion of the South one-half(S 1/.2) of Lot 20, ,Black 31, ;Easley Subdivision of the City of Lubbock, Lubbock County, 'Texas, land:being more par- ticularly described by metes and bounds as follows, to'-wit: BEGINNING at the Southeast corner of Lot 19, Block 31 of the Easley Subdivision;. THENCE North along the east line of Lots 19 and 20 of the afore- said Easley Subdivision a distance of 60.0 feet to a point, said point being 20.0 feet North of the Southeast corner of said Lot ZO; THENCE West, parallel to and ZO.0 feet North of the South line of Lot 20 of said Easley Subdivision, a distance of 15.96 feet to a point; THENCE South 80 23t 041 West a distance of 60.6 feet, more or less, to a point'in the South line of the said Lot 19, Block 31, Easley Subdivision; THENCE East along the South line of said ,Lot 19, a distance of 24.80 feet to the plaice of beginning. SECTION 2. Such deed shall. contain a provision to the effect that all direct access from the property to Avenue Q North Drive shall be prohib- ited and that such prohibition of access shall be construed as a covenant running with the land and that acceptance of such conveyance by the grantee shall constitute a recognition. of such prohibition of access and shall be construed as a full and. complete relinquishment and release by the grantee, his heirs and assigns, of the usual right or claim of right as an abutting owner for access to such street or highway. SECTION 3. That the City Secretary-Treasurer shall attest such con- veyance, affixing the seal of the City of Lubbock thereto. SECTION 4. That after such deed has been duly executed and.properly attested, the same shall be delivered to said.A. 3. Richardson upon his payment to the :city the sum. of $1, 224.
