The company to pay to the City of Lubbock and to utility com- panies lawfully using said alley for all utility changes required to be made to permit the construction hereinbefore mentioned, the changes to be determined by the City Engineer and done ac- cording to requirements of the City Engineer, it being further understood all costs of every character incident to the instal- lation, construction and utility changes necessary or inciden- tal to be paid by the company; and'. WHEREAS, the City Commission has duly considered the foregoing pro- posal submitted by the Standard Milling Company, Inc. , and is of the opinion that granting license for such alley use is at this time proper; NOW, THERE- FORE, ' CITY OF LUBBOCK MEMORANDUM,Inter Office TO: Vaughn Wilson Date August 4, 1955 FROM: John L. Scott 3UBJECT: Agreement Covering Use of N-S Alley Between 4th & 5th Streets Between Avenue N and Avenue 0 The Standard Milling Company, Inc. has requested thru. its presidents Mr.- Walker Stanton (Sec. Mrs. Annie P. Stanton) authority to construct certain. grain handling equipment in the above alley. s The following items will have a bearing on the documents which need to be prepared to fully cover the situation. (1) We were unable to finch an Ordinance granting the railroad or the Industry authority to lay an industry track in this alley. (2) Industry is requesting authority to do the following: (a) Install a 16 foot concrete hopper under the track into which grain can be unloaded from railroad cars. One rail could be carried. on a steel girder, `` the other on a concrete footing which is a part of the hopper. A grid - 1i" spacing, is to be in- stalled between the rails over the unloading hopper. Sheet steel cover plates will be placed on the grill when it is not in use. These plates will be removed and replaced by hand. Alley way is to be paved for approximately 70 feet South of 4th Street. The unloading hopper will be at mid point of this 70 foot pavement. Pavement will be to City specification. egg. (b) A car pull is to be installed by the industry at the unloading hopper to pull loaded cars over the hopper. Mr. Stanton has advised that he is pur chasing a gasoline driver small locomotive which will pull the empties from off the hopper, across= 4th Street, and place them on the industry track for the railroad to pick up and move them to the yard. His employees will operate the gas locomotive We have or should grant the railroad authority to maintain and operate trains or switching movements across 4th Streets but not the Industry. .. / (e) The Industry is also installing a "grain shovel" mounted on the side of its grain elevator on the West side of the alley at a height of 25 feet plus. This shovel will consist of a motor driver driven with a cable which is to travel down vertically to a shine or pully placed at car floor elevation, thence horizontally toward and into a car so that the operator can drag grain out of the car into the hopper. (e) All changes in utilities are to be paid for by the Industry., also, it will bear all paving costs. Holmes Mr. George Hay BE IT RESOLVED BY THE CITY.COMMISSION OF THE CITY OF LUBBOCK: THAT the Mayor BE and he is hereby authorized and directed to exe- cute a license to the Standard Milling Company, Inc. of Lubbock, Texas, authorizing the construction, use and installations proposed by the com- pany as set-out in the pre table of this resolution upon the following con- ditions; namely, that; 1. Standard Milling Company, Inc., by its proper officers, duly execute the license agreement, accept the same and agree to hold the City-of Lubbock, its officers, agents, servants and employees harmless from any and allciAims, damages, suits, attorneys' fees, causes of action, and judg- ments which may or might grow out of or be connected with or related to any and all uses made -of said alley by virtue of ' such license authorizing the construction, alley use and ap- purtenances. 2. Said license to be in --customary form and substance, and further providing that the same may, by the City.Commis- sion, be cancelled upon sixty (60) days, notice, zthat said license shall be in effect one year from its date and shall jcontinue in effect for yearly periods thereafter until can- celled by the City Commission. i 3. The Standard Milling Company, Inc. shall provide the City of Lubbock with a certificate of insurance, showing that the company and the City of Lubbock are adequately protected by public liability and property damage insurance,,, with min- imum'liniits of $10, 000.00 property, damage,,',$25„ 00.0.00 bodily injury one.person, ;and $50, 000. 00 bodily !injury more than one person. , The license to be ,non-transferable with out written approval of the City Commission. Passed by the Commission on this llth day of August, 1955.
