A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AND DELIVER 'I
TO R. McGEE AND WIFE, MARGERY LOFLIN McGEE, A':RELINQUISHMENT
OF A 'UTILITY EASEMENT OVER AND ACROSS THE LANDS MORE PARTIC-
ULARLY'DESCRIBED IN THE BODY OF THIS RESOLUTION, AND BEING THE
SAME,,GRANTED'TO THE CITY BY INSTRUMENT DATED JUNE 12, 1951.
..:WHEREAS R'« McGee and wife, Margery Loflin McGee, executed and de-
livered to the City.'of Lubbock a,perma.nent easement for utility purposes
across and over certain lands in the Alta Vista. Acres, an Addition to the City
of Lubbock; and,
II WHEREAS, the o ners of such land,tpgether with the owners of other
lands in this area, have agreed to`repla.t:a.nd dedicate an alley across and
I through said land; and,

WHEREAS, the City Commission findsthat it will be to the public interest
to have said lands repla.tted and re-dedicated for alley purposes, and will be
to the public interest to release and relinquish easement over the lands here- i
inafter described to R. McGee and wife, 'Margery'Loflin McGee; NOW, THERE-1�

I� BE IT RESOLVED BY THE. CITY COMMISSION OF THE. CITY OF LUBBOCK:

SECTION 1. THAT the Mayor BE, and he is hereby authorized and directed
to executea relinquishment on behalf of the City of Lubbock to R. McGee and
wife, Margery Loflin McGee of the .interest of the City in and to that certain
easement executed by R. McGee and wife, Margery Loflin McGee dated June �!
1Z, 1951, recorded in Volume 441 Page 490 in the Deed Records of Lubbock
County, Texas, encumbering the 'following described land, to-wit:
A fifteen (15) foot strip or parcel of land lying and being in the
Northwest one-fourth of Section 10, Block B, Lubbock County,
Texas; said parcel of land being more particolarly,described
it as follows:
BEGINNING at a point in the East line of Lot 2, Block 3, Alta
Vista Acres, a Subdivision of the Northwest one-fourth of Sec-
tion 10, Block B, Lubbock County, Texas, and which point-is I
166.5 feet South of the North line of Section 10-, Block B afore-
said;

THENCE South 280 27, East a distance of 27. 30 to a point;
!I THENCE North 790 49, East a distance of 135.66 feet to a point;
which is 166.5 feet South of the North line of Section 10, Block
B, aforesaid;
THENCE South a distance of 15 feet to a point;
,�- THENCE South 790 49, West a distance of 135. 66 feet to a point;
THENCE North 280 271 West a distance of 27. 30 feet to a point
in the East line of Lot 2, Block 3, Alta Vista Acres;

THENCE North a distance of 15 feet to the POINT OF BEGINNING.

SECTION 2. That the City Secretary-Treasurer shall attest such re-
linquishment, affixing the seal of the-City of Lubbock thereto.
