RESOLUTICK I
RESOLUTION ACCEPTING IMPROVEMENTS ON PORTIONS OF STREETS, AND/OR AVENUES
AS LISTED BELOW.
TIEREAS, the City of Lubbock passed resolution on June 24., duly 8, July 22,
August 12, August 26 September 9, and October 14, 1954, authorizing the
construction of street improvements by Kerr and Middleton on portions of various
streets in said City including among others the following:
2nd Street from its intersection with the NE Property Line of Clovis Road to its
intersection with the East Property Line of Avenue $, known and designated as
Unit Number 1625.
Avenue R From its intersection with the NE Property Line of Clovis Road to its
intersection with the South Property Line of .2nd Street, known and designated as i
Unit Number 1625.
46th Street from its intersection with the West Property Line of College Avenue
to its intersection with the West Property Line of Akron Avenue, known and
designated as Unit Number 1626.
30th Street from its intersection with the Fast Property Line of Peoria Avenue
to its intersection with a line 6t east of East 1roperty Line'tQuaker Avenue,
known and designated as 'Unit Number 1631.
„r.. 13th Street from its intersection with the West Property Line of Avenue A, to its
intersection with the West Property Line of lst alley west of Avenue A, known i
and designated as Unit Number 1636.
40th Street from its intersection with the East Property Line of Flint Avenue
to its intersection with the East Property Line of Gary Avenue, known and
designated as Unit Number 1645.
Avenue L from its intersection with a line 2t S. of South Property Line of .59th
Street to its intersection with a line 171 north of North Property Line of 60th
Street, known and designated as Unit Number N-S 69.
Avenue L from its intersection with a line 171 south of South Property Line of
60th Street to- its Intersection with a line 2.51 -S. of South Property Line south
of 60th Street, known and designated as Unit Number N-S 70.

48th Street from its intersection with a line 15t east of Fast Property Line of
Avenue W-to its intersection with a line 15t west of"the Went Property Line of
Avenue X, known and designated as Unit Number N-S 87.
AND WHEREAS, the improvements upon the said portions of the abovementioned
streets have been inspected and found to have been constructed according to the
approved plans and specifications.
THEREFORE, BE IT RESOLVED BY THE CITY OF LUBBOCK, TEXAS:
I.
That the improvements on said portions of the abovementioned streets be,
and the same are hereby accepted and the City Engineer be and is hereby.authorized
to direct the payment of the Cityts share on the due date as shown on the
attached consolidated sheet.

This resolution shall take effect and be in force after its passage.

that all labor, material, supplies and ocher cost including equipments rental and
hire, and all expense items incurred in connection with said project have been paid
in full; that all liens and rights to fine liens against any part of said project
or the moneys, bonds, or warrants due the Contractor, have been satisfied by payment
to the claimant,, his authorized agent or attorney, and full release of all recorded
liens Or claims have been sec-ured by settlw4ent and duly filed of record with the
County Clerk of Lubbock County.
I further represent and affirm that all Federal, State and Municipal
Laws were substantially complied with by me in doing and carrying out the job
end project herein referred to and that I paid applicable scale of wages, and
this affidavit is made to secure acceptance of these improvements by the City
Commission and therefore cause the first payment of the property owner portion of
the cost as set forth in the property owner contracts to become due and payable
within ten days of such acceptances and this affidavit is also made to secure
payment of the City°s portion due the contractor upon the date of city payment as
set forth in the resolution of authorizations
