WHEREAS, the City Commission of the City of Lubbock has approved the ap-
praisal by the Lubbock Real Estate Appraisal Committee, Robert W. Wright, Tom
Sawyer, and A. T. Coeanougher, for the widening of 4th Street between the rail-
road and Avenue "H"; NOW, THEREFORE

Beginning at a point, said point being located on the South line of Sec-
tion 79, Block "A", 2473.96 feet East of the Southwest corner of Section 79,
Bhek"A", said point being ;the Southwest corner of a tract of land described
in a deed recorded in Volume 238, Page 392, Lubbock County Deed Records;
Thence East along the South line of Section 79, Block "A" and the North
line of Section 1, Block O, a distance of 26-3 feet to a point;
Thence South a distance of 12,1 feet to a point;
Thence West a distance of 30.2 feet to a point;
Thence North a distance of 12.1 feet to a point, said point being in
the South line of Section 79, Block "A";

Thence East a distance of 3,9 feet to the POINT OF BEGINNING,
BE offered by a Right-of-Way Agent of the City of Lubbock, the sum of Three
Hundred Sixty-five and NoAOO"($365.00) Dollars for the above described prop-
erty, and the sum of One Thousand One Hundred Thirty-five and No/100 (t1,135.00)
Dollars for the removal of this building occupying the above described land and
the reconstruction of an equal number of square feet of floor space to the North
side of said building and 'any other miscellaneous costs which may arise from
the removal and reconstruction of said building. Possession of the above prop-
erty to be delivered to the City of Lubbock free and clear of any and all liens,
encumbrances or claim of any nature.
SECTION 2. THAT in the event J. A. Mullins and Kitty J. Mullins refuse
to accept the above offer for the tract of land described in Section 1 (One),
then the City Attorney BE, and he is hereby authorized and directed'to file
condemnation proceedings against the said J A. Mullins, Kitty J. Mullins, and
all other persons having an interest It. said property.to acquire fee simple
title, the same being required for the openings extension and widening of

On motion of Commissioner Forrest , seconded by Comois-
r 'f sioner Carpenter , the foregoing Resolution was passed on this
