WHEREAS, the Highway Department proposes to construct and pave a farm
to market road on North College Avenue extended to conform to the approved
Master Thoroughfare Plan of. the City of Lubbock and a wider right-of-way is
required abutting a quarter section of land owned by the City of Lubbock and
the Commission finds that such construction would be in the public interest;
THEREFORE,
BE IT RESOLVED BY THE CITY COHIISSION OF THE CITY OF LUBBOCK:
THAT the Mayor BE, and he is authorized and directed to execute a Right
8f Way Easement to the State of Texas, covering a strip of land of the entire
East side of the North One Huiidred Sixty (160) acres of the Northeast part of
Section Twelve (12), Block A, less about three-tenths (3/10) of an acre be-
longing to Lubbock County, said strip of land being more particularly des-
cribed by metes and bounds in the Easement submitted by the Highway Depart-
ment for execution.
This Resolution passed by unanimous vote of the City Commission this
26th day of August, 1954.

'County Deed Records, said strip of land being described by metes and bounds as follows:
L Beginning at a point in the north boundary of said Sectitn, sald point being 69.4
feet West of the northeast corner of said Section 12;
Thence Westerly along said north boundary, at 17.0 feet pass the center of the
present paved county road and the proposed centerline of F. M. Highway 1264 and continuing
in,all a distance of 60 feet;
Thence Southerly along a line 43 feet from and parallel to the proposed centerline.

' radius 2907.93 feet, said point being 43 feet West of and at a right angle to the
.proposed centerline of said Highway at its Atation 212 /00;
Thence around said curve to the left along a line 43 feet from and concentric with
the proposed centerline of said Highway a distance of 380.E feet to a point the end of
said curve, said point being 43 feet from and at a right angle to the proposed centerline

Thence Southeasterly along a line 43 feet from and parallel to the proposed center-

distance of 389.4 feet to the place of beginning.
Containing 3.713 acres of land more or less of which approximately 1.421 acres
are in use as a county road.
For the purpose of opening, constructing and maintaining a permanent highway in, along,
upon and across said premises, with the right and privilek3 at all times of the grantee
herein,

improvements on and repairs to. the said highway, or any part thereof.
t is specifically understood that the State and its assigns shall be vested with the
title to and the right to take and use, without additional compensation, any stone, earth,
rgrave , caliche.or any other materials or minerals upon, in and under sail land, except
j.loill 4ae and sulphur, for the construction and maintenance of, the Highway System of Texas.
And it is further: agreed that Lubbock County in consideration of the benefits. above
