HomeMy WebLinkAboutResolution - 5006 - Correction Quitclaim Deed- The Urban Renewal Agency- Wheelock's Second Addition - 11_09_1995Resolution No.5006 November 9, 1995 Item #14 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock a Correction Quitclaim Deed in favor of The Urban Renewal Agency of the City of Lubbock, which Deed is attached hereto and shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Johnson, ity Secretary APPROVED AS TO CONTENT: Ed Bucy, Right -of -Way APPROVED AS TO FORM: 9-iiwa Harold Willard, Assistant City Attorney 1iW:js/CQD-URA.RES ccdocs/October 10, 1995 Resolution No. 5006 November 9, 1995 Item #14 1;:__ 1► 1_ 11 � 1 DI THE STATE OF TEXAS KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LUBBOCK § WHEREAS, the Mayor of the City of Lubbock, Texas, on or about October 8, 1970, executed on behalf of the City a Quitclaim Deed recorded in Volume 1248, Page 51 of the Real Property Records of Lubbock County, Texas; and WHEREAS, there was an inadvertent error in the legal description of the property conveyed or attempted to be conveyed in such Deed; and WHEREAS, the City desires to correct the error in the legal description of the property incorrectly described in Volume 1248, Page 51 of the Real Property Records; NOW THERE- FORE, the following Quitclaim Deed is herewith executed and filed in correction thereof and in lieu of said Deed executed on or about October 8, 1970, and filed of record in Lubbock County, Texas, to -wit: THE STATE OF TEXAS § KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LUBBOCK § THAT the CITY OF LUBBOCK, a Home Rule Muncipality in the County of Lubbock, State of Texas, hereinafter called "GRANTOR", for and in consideration of the sum of TEN AND NO/100 DOLLARS ($10.00) and other good and valuable consideration to GRANTOR in hand paid by THE URBAN RENEWAL AGENCY OF THE CITY OF LUBBOCK, hereinafter called "GRANTEE", the receipt of which is hereby acknowledged, does hereby by these presents ABANDON, DISCLAIM, RELEASE and FOREVER QUITCLAIM unto the said GRANTEE, all of GRANTOR'S rights, title and interest in and to that certain tract or parcel of land lying and being situated in the County of Lubbock, State of Texas, described as follows, to - wit: BEGINNING at the Southwest corner of Lot 7, Block 41, Wheelock's Second Addition to the City of Lubbock, Lubbock County, Texas; THENCE South, a distance of 25.00 feet to a point; THENCE East, a distance of 140.00 feet to a point; THENCE North, a distance of 25.00 feet to the Southeast corner of Lot 7, Block 41, Wheelock's Second Addition; THENCE West, a distance of 140.00 feet to the PLACE OF BEGINNING. TO HAVE AND TO HOLD the same premises together with all and singular the rights, privileges and appurtances thereto in any manner belonging unto the said GRANTEE, its successors and assigns forever, so that neither the GRANTOR, its successors or assigns, nor any persons claiming under GRANTOR shall at any time hereafter have, claim or demand any right to the title to the aforesaid premises or appurtenances or any part thereof.
