HomeMy WebLinkAboutResolution - 051354A - Pavement Improvements - City Engineer - Memphis Avenue - 05_13_1954 nS13S.-�E A RESOLUTICN WHEREAS, the City Commission has heretofore determined t hat the City would contribute the customary city portion of from ten (10) to forth (40) per cent of the cost of strreet paving improvements, as determined by side and front property, to be constructed in accordance with the standard City of Lubbock street plans and specifications as approved by the City Engineer, and'the owners ,of property abutting �emphis Avenue ;from 33rd Street to 34th Street, have requested permission to have phvement improvements constructed on the aforementioned Memphis Avenue, and the pavirig'of said Memphis Avenue is needed to provide access to the area during its' construction perios, and the City Engineer has approved the plans and specifications for such improvments, and, WHER OO Hugh Small and the other oThners of the property abutting on the herein described avenue will contract separately with a competent contractor" for the above:=street improvements, and said improvements will be constructed in 4 ccordance with the abovementioned plans and specifications under the supervision of the City Engineer, and the said owners desire that the City contribute' its' customary share towards such paving, and, WHEREAS, the contract cost of the paving improvements will not exceed 420639.54, the'total cost not over $ 2,771.52, the City's share in connection therewith would'; not exceed $912.44, leaving the property ownerls portion not to exceed 01 059.0 , such costs being well within the current prices For paving obtained -by competitive bidding, and that such payment to be`made by the City is reasonabl,e ;fairand just to the abutting property owners, the City and all other persons affect d thereby, and that the sum of $912.44 will be duly budgeted in the 1954--1W udget. THEREFORE, BE IT' RESOLVED BY THE CITY COMSSION. OF THE CITY OF LUBBOCK: Section 1 , THAT, the City Engineer be and he .is hereby authorized to approve plans and specifications for paving on the avenue herein described, provided that such plans: andspecifications meet the usual requirements for paving on streets within th'e' corporate limits of the City of Lubbock; said streest being as follows, to wit: Unit No. 1602 Memphis Avenue from its intersection with the South Gutter Line of 33rd Street to its intersection with the North Paving Line of 34th Street. The City Engineer is further authorized and directed to duly inspect said paving construction on said Memphis Avenue and to require strict compliance with 111 the approvd plans and specifications, and upon completion of said paving, and upon final `approval by the City Engineer and acceptance of such improvements by the City C, ssion, the City Engineer is authorized to pay the contractor in full and final payment of the Cityls share of the cost of the abovementioned improvements a ',sun not to exceed $780.k6 which is the City share $912.44 less $$131.98 en 3.neering, leaving the amount due the contractor from the property owner not to exceed $1,859.08. Section 2.! This authority is conditioned that Hugh Small and the other owner of abutting p�6perty and the contractor will pay for all material and labor and costs inciq ntal to such construction, indemnify the City of Lubbock against any costs, cla6s' or damages of eveiy nature pertaining thereto, and that the Contract furnish the City Engineer with acceptable evidence that the contractor and his sub-contractors, if any, are adequately covered by public liability and property damage insiiiari6e policies, that .the said Hugh Small and other owners of abutting property will cause such paving to continue to be done according to the approved 1 plans and specifications, and that upon completion thereof and final approval of the City Engineer, all improvements designated herein shall be a permanent part of said Memphis Avenue and the property of the City of Lubbock, without any liability whatsoever, except for the payment of a sum V$0.46 to the Contractor on December 15, 1954• On motion of Commission T,homas, }. seconded by Commissioner Carptrntter„ , the foregoing resolution was unanimously passed by the City Commission this,J.Lday of May r Murrell $eTri .....
