HomeMy WebLinkAboutResolution - 040854B - Paving Plans_Specs. - City Engineer - Jarvis St, & Itasca St - 04_08_1954 RESOLD ION WHEREAS, the City Commission has heretofore determined that the City would contribute the customary city;portion of from ten (10) to forty (40): ,,per cent of the cost of street paving improvements, as determined by side and front/property-, to be constructed in accordance with the standard City of Lubbock street plans and specifications as approved by the City Engineer, and the owners '6f property, Copy to abutting Jarvis Street from Indiana Avenue to Itasca Street, Itasca street from' Alderson Indiana Avenue to Hartford Avenue have requested permission to have paveiment im- 4-16.-54 provements constructed on the 'aforementioned Jarvis Street and Itasca Street and the paving of said Jarvis Street and Itasca Street is needed to protidejaccess to the area during its .eonstruetion period, and the City Engineer has �pprovrod the plans and specifications for such improvements., and, WHEREAS, Ray W. Face, and other owners of the property abutting on the herein described streets will contract separately with a competent contractor for the above street improvements, and said improvements will be constructed in accordance with the abovementioned plans and specifications under the supervision of the City Engineer, and they said owners desire that the City contrib- ute its customary share towards such 'paving, and, WHEREAS, the contract cost of the paving improvements will not exceed $1.4t794.77, the total cost not over $15,534.51, and the Cityts share ;in connection; therewith would not exceed $936.23, leaving the property ownerts portion not to exceed $11+,598.28, such costs being well within the current prices fcr paving obtained by competitive bidding, and that such payment to be made byiijthe City is reasonable fair and just to the abutting property owners, the City aid ail other �,. persons affected thereby, and that the sum of $936,23 will be duly budgeted in the 1954-1955 budget, THEREFORE, BE IT RESOLVED BY THE CITY COMISSION OF THE CITY OF LUBBOCK: Section 1. THAT, the City Engineer be and he is hereby authoiized:,to ap- prove plans and specifications for paving on the streets herein deseribed, provided that such plans and specifications meet the usual requirements for paving on street within the corporate limits of the City of Lubbock; said streets being 'as' follows, ' to-wit: Unit No. 1598 Jarvis Street from its intersection with a line 20T EisV*f the East Property Line of North Indiana Avenue to a line 20t North of the North Property Line of Itasca Street Unit No. 1599 Itasca Street from a line 20t East of the East Property Maine of North Indiana Avenue to a line 20t West of the West Pry rty Line of North Hartford Avenue. The City Engineer is further authorized and directed to duly inspect said paving construction on said Itasca Street and Jarvis Street and to re wire strict compliance with the approved plans and specifications, and upon eompltian of said paving, and upon final approval by the City Engineer and acceptance okliuldh im- provements by the City Commission, the City Engineer is authorized tolp, 4' the con- tractor in full and final payment of the Cityts share of the cost of tie" ibovemen- tioned improvements a sum not', to exceed $196.49 which is the City sha e+l 036.23 less -1739.74 a ineer leaving the amount due the contractor from Ze 'ro rt � r; 1 p pe Y owners not to exceed $14,598.28. ,a Section 2. This authority is conditioned that Ray W. Pace and the other owners of abutting property and the contractor will pay for all material and labor and costs incidental to such construction] indemnify the City of Lubbock against any costs, claims or damages of every nature pertaining theretot and that the Contractor furnish the City Engineer with acceptable evidence that the contractor and his sub-contractors, if any, are adequately covered by public liability and property damage insurance policies, that the said Ray N. Pace and other owners of abutting property will cause such paving to continue to be done according to the approved plans and specifications, and that upon completion thereof and final approval of the City Engineer, all improvements designated herein shall be a permanent part of said Jarvis Street and Itasca Street and the property of the City of Lubbock, without any liability whatsoever, except for the payment of a sum $196.49 to the cortraetor after December 15, 1954.
