JOHNSTON, a feme;sole, appeared in person before the City Commission and there presented directly to the governing body of said City her offer to bargain, sell, release and forever quitclaim all her right, title C and interest in and to the lands described in the body of this resolution com- plete and 'without reservation, with:immediate' possession to said property to be in, all things delivered and surrendered'to the City of Lubbock as of the date of execution of her quitclaim deed effecting that purpose for a :cash con- J7-j y ��`� sideration of Ten Thousand Dollars ($10, 000. 00) to be paid to her upon delivery of said deed and the further consideration :that seven (7) small frame houses heretofore purchased by the said City frozn Al OlBrien in connection with the requisition of right'-vf-way for 'Northeast Avenue Q be sold and delivered'to' her in their present condition, to be moved at the expense of the City to a location.designated by her not exceeding a distance of five (5) miles from their present location and, WHEREAS , the City Commission, .after duly considering such offer as an entirely new and separate agreement in all things taking the place of the agreement heretofore repudiated by Fronia S. Johnston and thereafter abandoned by resolution of the City Commission, as shown and ;stated in such resolution in Minute Book 12 at page 424 and as a compromise and .. settlement of the controversy between the City of Lubbock and the said Fronia S. Johnston over the lands and property',hereinafter described, finds that it would be in the public-interest to accept such offer as hereinabove set forth, submitted directly to the Commission by the said Fronia S. Johnston; NO W , THEREFORE , BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: T HA T the proposal and offer of Fronia S. Johnston, a feme sole, of Lubbock County, Texas,-to give the City of Lubbock immediate possession and deliver to said City a'quitclaim deed of the following property, to-wit: Being all of that tract or parcel of land known and designated as Lots Eight (8) and Nine (9), Block Sixteen (16), Original Town of Lubbock, Lubbock County, Texas; also all of that tract, strip or parcel of land lying between the East Boundary Line of said Block 16, Original Town of Lubbock, and the East Boundary Line of Section One. (1), Block O, Lubbock County, Texas, said strip, tract or parcel of land being bounded on the South by Fifth Street and on the North by the North Boundary Line of Section One (1), Block O; also all that part of Old Fourth Street lying North of the North line of the Original Town of Lubbock, as shown by the plat thereof of record in the Lubbock County DeedRecords, and South of the North Boundary Line of said Section One (1), Block 0, be- ing bounded on .the West by, projecting the East line of Avenue C -, North to the North line of said Section One (1), Block O, and bounded on the East by the ,East Boundary Line of Section One (1), Block O; also all of Avenue A lying,North of Fifth'Street as shown on the Original Town Plat and South of Old Fourth Street; also all right, title and interest of the said Fronia S. Johnston in and to U, A. '- all of the land lying North of Fifth Street, East of Avenue C, South of the North line of said"Seetion One (1), Block.0, and West of the East line of Section-One (1), Block 0, all in the City of Lubbock, Lubbock County, Texas, whether hereinabove specifically described and designated or not, for the consideration of Ten Thousand Dollars ($10, 000. 00) cash and seven (7) small frame houses recently purchased from, Al O'Brien in connection with the acquisition of right-of-way for Northeast Avenue 0, .at the present time located on the said Al O'Brien property, BE and,the same is hereby accepted, and the Mayor is hereby authorized and directed to pay over to the said Fronia S. Johnston the sum of Ten Thousand Dollars ($10, 0000 00) upon receipt of a. quit- claim deed to the hereinabove described property and delivery and surrender of possession by the said Fronia S.. Johnston of all of said property; and the Mayor is further directed to cause the removal, at the Cityts expense, of the said seven (7) small frame houses to a location designated by the said Fronia S. Johnston not to exceed a distance of five (5) miles, from their present loca- tion. The payment of said sum, together with the'moving of the said houses to said property constitutes and 'shall be the sole consideration and obligation on the part of said City, according to the offer and agreement with the said Fronia S. Johnston, and nothing more than that herein provided for shall be done except the payment of the Federal Stamp Tax on the transaction. The Cash-consideration, the expense incurred in moving the seven (7) small frame houses above mentioned, and the Federal Stamp Tax on this transaction shall be paid out of the 1946 Street Improvement Fund(Right-of Way Bond Fund), the property hereinabove described being needed for right- of-way purposes for the construction, opening, extending and laying out of a multi-lane highway to be constructed by the Texas State Highway Department and commonly walled the New Fourth Street. i On motion of Commissioner Thomas , seconded by Commis- sioner Carpenter this Resolution was passed on this the 17 day of March, 1954, by the following. vote; Commissioners voting "YEA": Morris,Carpenter,Davis,Thomas & MayorTripp Commissioners voting "NAY": None IMUL yor--- -_.L A T T L.ay. nia Lowe, it�retary-Treasurer WLS:sv 3-18-54
