HomeMy WebLinkAboutResolution - 100853A - Contract Refund-From Texas Highway Commission-Texas Tech Collage Paving Project - 10_08_1953 i r t CO WA / RESOLUTION WHEREAS, on March 26., 1953, an agreement was entered into between the City and the State of Texas acting through its State Highway Commission providing for certain work to be performed by the State Highway Department Contractor in con— nection with the Texas Tech Freeway, a portion of Loop Highway No. U. S. 62 and, �, . WHEREAS., the City issued a Warrant payable to the State Treasurer, Account Trust Fund ##927 in the amount of 033,500.00 to pay for the work required by the Lag • . " '"�. City in accordance with its agreement with the Texas Technological College per— J-w.- twining to the construction of a grade separation to serve the property of the Texas Technological College and, WHEREAS.. due to delay in the receipt of steel for the Railroad Overpass., there is now a possibility that a portion of the work to be done by the contractor on Railroad right-of-way cannot be constructed in the scheduled time required to avoid seriously delaying the State Highway Department Contractor in the prosecu— tion of his contract, NOW THEREFORE, BE IT RESOLVED BY THE CITY CONNISSION OF THE CITY OF LUBBOCK: THAT., for aid in consideration of the return to the City of the unused balance of the previously deposited $33,500.00, the City will, if necessary., assume the responsibility of completing the following work in conjunction with the construction of the grade separation to serve the Texas Technological College: 1. Excavation and disposal of the remaining earth work to be removed from under the Railroad Overpass. 2. Construction of curb andgutter concrete pavement, caliche base and asphalt pavement in conjunction with the grade separation and any other items necessary for complete facilities in connection with the grade separation. On motion of Commissioner Davis seconded by Commissioner Thhmaa ., the foregoing resolution was unanimously passed by the City Commission this Sth day o p Octobe 1953.
