RESOLUTION
RESOLUTION APPROVING AND ADOPTING ESTIMATE OF THE COST OF IMPROVEMENTS,
OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS IN THE NATURE OF GRADING, LAYING
CURB AND GUTTER AND PAVING CERTAIN "LEAVEOUT" PORTIONS QF CERTAIN STREETS,
HIGHWAYS AND/OR AVENUES IN THE CITY OF LUBBOCK, TEXAS,V'OR ALONG THE BOUNDARY
OF SAID CITY, SAID IMPROVEMENTS BEING DESIGNATED AS PART OF GWO NO.667, FIXING
THE TIME AND PLACE FOR A HEARING TO THE OWNERS OF ABUTTING PROPERTY, AND OTHER
PERSONS INTERESTED IN SAID PROPERTY AND DIRECTING THE CITY SECRETARY TO PUBLISH
NOTICE ON BEHALF OF THE GOVERNING BODY OF THE CITY OF LUBBOCK, TEXAS.
WHEREAS, the Governing Body of the City of Lubbock has heretofore
ordered that certain "leaveout" portions of streets,, highways and/or avenues be
improved by grading, installing concrete curb and gutter and paving with caliche
base and quadruple asphalt surface together with incidentals and appurtenances
and arrangements therefore have been made and entered into by the City of Lubbock,
Texas with Elliott Taylor, Contractor, and,
WHEREAS, the Governing Body of the City of Lubbock has caused the
City Engineer to prepare and file estimates of the cost of such improvements
and estimates of the amounts per front foot to be assessed against abutting
property and the owners thereof, and such estimates have been prepared and
�^ examined;
THEREFORE, BE IT RESOLVED BY THE CITY CONMSION OF THE CITY OF LUBBOCK,
TEXAS
I.
Such estimates be and they are hereby adopted and approved.
II.
NOTICE
TO THE OWNERS OF PROPERTY ABUTTING UPON THE HEREIPIBELOW 14ENTIONED
"LEAVEOUT" PORTIONS OF STREETS, HIGHWAYS, AND/OR AVENUES APID TO ALL OTHERS
AFFECTED:
The Governing Body of the City of Lubbock has heretofore ordered that
the following "leaveout" portions of the following streets, highways and/or
avenues in and along the boundary of the said City of Lubbock, Texas, be improved
by raising, grading and filling and installing concrete curbs and gutters and
storm sewers and drains where necessary on the "leaveout" portions of streets,
highways and/or avenues as designated below
It is hereby found and determined that the cost of improvements on such
"leaveout" portions of said streets, highways and/or avenues with the amount or
.. amounts per front foot proposed to be assessed for such improvements against the
abutting property and the owners thereof, on the said "leaveout" '`portions of said
streets, highways and/or avenues are as follows, to—wit: !',
"Leaveout" at 2421-2423 6th Street, abutting Lots 11, 12, Block 131, Overton
Addition, known and designated as Unit No. L.O.-2; the estimated cost of
improvements is $398.98; the estimated amount per front foot to be assessed
against the abutting property and the owners thereof for curt is $0.55; the
estimated amount per front foot to be assessed against the abutting property
and the owners thereof for improvements exclusive of curb is $1.6952.
"Leaveout" at 2301-2303 7th Street, abutting Lots 1,2, Block 127, Overton
Addition, known and designated as Unit No. L. 0.-3; the estimated cost of
improvements is $353.72; the estimated amount per front foot to be assessed
against the abutting property and the owners thereof for curb is $0.55; the
estimated amount per front foot to be assessed against the abutting property
and the owners thereof for improvements exclusive of curb is $1.4964.
"Leaveout" at 1801-1805 7th Street, abutting Lot 1, Block 112, Overton Addition,
known and designated as Unit No. L.O.-4; the estimated cost of improvements is
0538.07; the estimated amount per front foot to be assessed against the abutting
property and the owners thereof for curb is $0.55; the estimated amount per
front foot to be assessed against the abutting property and the owners thereof
exclusive of curb is $1.549898.
"Leaveout" at 802-806 Avenue S. abutting Lot 1, Block 29, Overton Addition,
known and designated as Unit No. L.O.-5; the estimated cost of improvements is
$410.93; the estimated amount per front foot to be assessed against the abutting
property and the owners thereof for curb is $0.55; the estimated amount per
^ front foot to be assessed against the abutting property and the owners thereof
for improvements exclusive of curb is �1.336549.
"Leaveout" at 902-906 Avenue U, abutting Lot 1, Block 58, Overton Addition, known
and designated as Unit No. L. 0.-6; the estimated cost of improvements is
423.47; the estimated amount per front foot to be assessed against the abutting
property and the owners thereof for curb is 00.55; the estimated amount per
front foot to be assessed against the abutting property and the owners thereof
for improvements exclusive of curb is $1.385725,
"Leaveout" at 907-909 Avenue S, abutting Lots 6,7, Block 116, Overton Addition,
known and designated as Unit No. L. 0.-7; the estimated cost of improvements
is 367.46; the estimated amount per front foot to be assessed against the
abutting property and the owners thereof for curb is $0.55; the estimated amount
per front foot to be 'assessed against the abutting property and the owners
thereof for improvements exclusive of curb is $1.380270.
"Leaveout" at 2302-2308 13th Street, abutting Lots 21,22,23,24, Block 84,
Overton Addition, known and designated as Unit No. L. 0.-8; the estimated cost
of improvements is $767.08; the estimated amount per front foot to be assessed
against the abutting property and the owners thereof for curb is 0.55; the
estimated amount -per front foot to be assessed against the abutting property
and the owners thereof for improvements exclusive of curb is $1.6427.
"Leaveout" at 1407-1409 Avenue R, abutting Lots 6,7, Block 9, Overton Addition,
known and designated as Unit No. L. 0. -9; the estimated cost of improvements
is $377.18; the estimated amount per front foot to be assessed against the
abutting property and the owners thereof for curb is $0.55; the estimated amount
per front foot to be assessed against the abutting property and the owners
thereof for improvements exclusive of curb is �1.424054.
"Leaveout" at 1906-15th Street, abutting Lot 22, Block 23, Overton Addition,
known and designated as Unit No. L. 0. -10; the estimated cost of improvements
is 178.65; the estimated amount per front foot to be assessed against the
abutting property and the owners thereof for curb is $0.55; the estimated amount
per front foot to be assessed against the abutting property and the owners
thereof for improvements exclusive of curb is $1.5116.
"Leaveout" at 1610 Avenue U. abutting Lot 24, Block 51, Overton Addition, known
and designated as Unit No. L. 0. -11; the estimated cost of improvements is
$428.69; the estimated amount per front foot to be assessed against the abutting
property and the owners thereof for curb is $0.55; the estimated amount per
front foot to be assessed against the abutting property and the owners thereof
,for improvements exclusive of curb is 01.401882.
"Leaveout" at 1702-1706 17th Street, abutting Lot 5, Block 7, Overton Addition,
known and designated as Unit No. L. 0.-12; the estimated cost of improvements
is $556.56; the estimated amount per front foot to be assessed against the
abutting property and the owners thereof for curb is 00.55; the estimated
amount per front foot to be assessed against the abutting property and the
owners thereof for improvements exclusive of curb is $1.60983.
"Leaveout" at 1701-1705 Avenue T, abutting Lot 12, Block 20, Overton Addition,
known and designated as Unit No. L. 0.-13; the estimated cost of improvements
is $261.71; the estimated amount per front foot to be assessed against the
abutting property and the owners thereof for curb is $0.55; the estimated amount
per front foot to be assessed against the abutting property and the owners
thereof for improvements exclusive of curb is $0.755686.
"Leaveout" at 1302-1308 15th Street, abutting Lot 11, Block 162, Original Town,
known and designated as Unit No. L. 0.-32; the estimated cost of improvements
is $416.24; the estimated amount per front foot to be assessed against the
abutting property and the owners thereof for curb is $0.55; the estimated amount
per front foot to be assessed against the abutting property and the owners
thereof for improvements exclusive of curb is $1.395520.
"Leaveout" at 501-509 15th Street, abutting Lot 20, Block 186, Original Town,
known and designated as Unit No. L. 0. - 33; the estimated cost of -Improvements
is $527.71; the estimated amount per front foot to be assessed against the
abutting property and the owners thereof for curb is $0.55; the estimated amount
per front foot to be assessed against the abutting property and the owners
thereof for improvements exclusive of curb is $1.8392.

"Leaveout" at 411-417 15th Street, abutting Lot 1, Block 187, Original Town,
known and designated as Unit No. L. 0.-34; the estimated cost of improvements
is $536.33; the estimated amount per front foot to be assessed against the
abutting property and the owners thereof for curb is $0.55; the estimated amount
per front foot to be assessed against the abutting property and the owners
thereof for improvements exclusive of curb is $1.87472. ,
"Leaveout" at 1925 Avenue P, abutting S2 of Lot 2, N' of 3. Block 9, McCrumments
2nd Addition, known and designated as Unit No. L. 0. -49; the estimated cost of
improvements is $169.03; the estimated amount per front foot to be assessed
against the abutting property and the owners thereof for curb is $0.55; the
estimated amount per front foot to be assessed against the abutting property
and the owners thereof for improvements exclusive of curb is $1.41540.
And arrangement for the making and construction of such improvements
with pavement of quadruple course asphalt surface treatment (Inverted Penetra-
tion Type) and a Six (6) Inch compacted caliche base has been made and entered
into by the City of Lubbock, Texas, with Elliott Taylor, Contractor, and rolls
or statements showing the proposed amounts to be assessed against abutting
property and the owners thereof have been filed with the City, such rolls or
statements showing other matters and things, and have been approved and the City
Commission of said City has fixed a tine and place for hearing to the owners of
property abutting upon said "leaveout" portions of said streets, highways and/or
avenues, and to all others affected, at which hearing the amounts to be assessed
against the respective parcels of abutting land and the owners thereof for
Improvements in the units upon which the particular parcels of property abut,
the .amounts of benefits to the respective parcels of property by means of the
improvements in the unit upon which the particular property abuts, the regularity
of the proceedings with reference to such improvements, the apportionment of the
cost of such improvements, and other matters and things will be determined, and
after such hearings assessments will by ordinance be made and levied, and such
hearing will be had and held by and before the City Commission of the City of
Lubbock, Texas, in regular Commission meeting room in the City Hall, in the City
of Lubbock, Texas on the day of rfay-_1 1952, at 2:00 P.M.. otclock. The rolls
or statements showing the proposed amounts of such assessments are on file in
the office of the City Secretary and copies thereof are in the office of the
City Engineer of the City of Lubbock and open to inspection of any interested
parties at any tine, and of all said matters and things all such owners of
property, as well as any and others in anywise affected or interested, will take
due notice.
By order of the City Commission of the City of Lubbock, this the loth
day of April 1952.
No notice other than that hereinabove provided for shall be necessary
but publication of such notice shall be due and sufficient notice to any and all
persons, firms, corporations and other parties.
III.
That a hearing be given and held by and before the Governing Body of
the City of Lubbock, Texas, to all persons owning or claiming any property
abutting any part of said "leaveout" portions of said streets, highways and/or
avenues described in Section II, of this Resolution, as well as all owning
or claiming any interest in any such property. Such hearing shall be given
and held on the '8th day of Hay:`Lt 1952, at 2:00 P.M. otcloch on the first
floor in the City Hall, City of Lubbock, Texas and the City Secretary is
hereby directed to give notice of the time and place of such hearing, and of
other matters and facts in accordance with the terms and provisions of an
Act passed at the first called session of the 40th Legislature of the State
of Texas and known as Chapter 106 of the Acts of said Legislature which has
been adopted as an amendment to and made a part of the Charter of the City of
Lubbock, Texas, and as amended by Chapter 281 Acts of the 52nd Regular
Session of said Legislature. Such notice shall be by advertisement inserted
at least three times in a newspaper published in the City of Lubbock, Texas;
the first publication shall be made at least ten days before the said
hearing. Said notice shall comply with and be in accordance with the terms
and provisions of this resolution and said Act as amended.

LUBBOCK, TEXAS, THIS, THE 10TH DAY OF APRIL 1952.
