HomeMy WebLinkAboutResolution - 032752B - Prepare Paving Estimates, Etc.- City Engineer- Ersking St & College Ave, GWO 659 - 03_27_1952 032:7S2-.1R GWO 65 RESOLUTION RESOLUTION APPROVING AND ADOPTING ESTIMATE OF THE COST OF DITROVEMENTS, OF AMOUNTS TO BE ASSESSED FOR IMPROVET-ENTS IN THE NATURE OF GRADING AND PAVING COLLEGE AVENUE FROM ERSKINE STREET TO U. S. HIGHWAY 84 AND ERSKINE STRUT FROM COLLEGE AVENUE TO U. S. HIGHWAY 87 IN THE CITY OF LUBBOCK, TEXAS AND ALONG THE BOUNDARY OF SAID CITY, SAID IMPROVEMENTS BEING DESIGNATED AS GI-10 NO.659, FIXING THE TIME, AND PLACE FOR A HEARING TO THE OWNERS OF ABUTTING PROPERTY, AND OTHER PERSONS INTERESTED IN SAID PROPERTY AND DIRECTING THE CITY SECRETARY TO PUBLISH NOTICE ON BEHALF OF THE GOVERNING BODY OF THE CITY OF LUBBOCK, TEXAS. WHEREAS, the Governing Body of.the City of Lubbock has heretofore ordered that College Avenue from Erskine Street to U. S. Highway 84 and Erskine Street from College Avenue to U. S. Highway 87 be improved by grading and paving with caliche base and quadruple asphalt surface together with incidentals and appur- tenances and arrangements therefore have been made and entered into by the City of Lubbock, Texas with Kerr and Middleton, Contractor, and, WHEREAS, the Governing Body of the City of Lubbock has caused the City_ Engineer to prepare and file estimates of the cost of such improvements and estimates of the amounts per front foot to be assessed against abutting property and the owners thereof, and such estimates have been prepared and examined; THEREFORE, BE IT RESOLVED BY THE CITY COMA'QSSION OF THE CITY OF LUBBOCK, TEXAS, THAT I. Such estimates be and they are hereby adopted and approved. II. NOTICE TO THE OTJNERS OF PROPERTY ABUTTING UPON COLLEGE AVEIM FROM NORTH PAVING LINE OF U. S. HIGHWAY 84 TO NORTH PROPERTY LINE OF ERSKINE ST -T A17D TO THE OWNERS OF PROPERTY ABUTTING UPON ERSKINE STREET FROM EAST PROPERTY LINE OF COLLEGE AVENUE TO THE WEST PAVING LINE OF U. S. HIGHWAY 87. AND TO ALL OTHERS AFFECTED, The Governing Body of the City of Lubbock has heretofore ordered that the above portions of College Avenue and Erskine Street in and along the boundary of the said City of Lubbock, Texas, be improved by raising, grading and filling and installing drains where necessary. It is hereby found and determined that the cost of improvements on such portions of College Avenue and Erskine Street with the amount or amounts per front foot proposed to be assessed for such improvements against the abutting property and the owners thereof, on such portions of College Avenue and Erskine Street are as follows, to-wit; O52wJS2 College Avenue from-its intersection with the Northerly Paving Line of U. S'. Highway Number 84 (Clovis Road) to its intersection with the North Property Line of Erskine Street and Erskine Street from its intersection with the East Property Line of College Avenue to its intersection with the West Paving Line of U. S. Highway Number 87 (Avenue H West), all of which is known and designated as Paving Unit Number 1351; the estimated cost of improvements is $ 93,814.56 the estimated amount per front foot to be assessed against the abuttin $$�joperty and owners thereof for improvements on College Avenue where eighty and width, of pavement is to be constructed is $ 7.27074 ; the estimated amount per front foot to be assessed against the abutting property and owners thereof for improvements on Erskine Street where forty eight (48) foot width of pavement is to be constructed is $ 4.68374 w:i.t,�i the exception of the SW Corner of Erskine and U. S.87 where the rate is elp'4.99274. And arrangement for the making and construction of such improvements with pavement of quadruple course asphalt surface treatment (Inverted Penetration Type) and a Six (6) Inch compacted caliche base has been made and entered into by the City of Lubbock, Texas, with Kerr and Middleton, Contractor, and rolls or statements showing the proposed amounts to be assessed against abutting property and the owners thereof have been filed with the City, such rolls or statements showing other matters and things, and have been approved and the City Commission of said City has fixed a time and place for hearing to the owners of property abutting upon said portions of College Avenue and Erskine Street, and to all others affected, at which hearing the amounts to be assessed against the respects parcels of abuttinff land and the owners thereof for improvements in the units upon which the particular parcels of property abut, the amounts of benefits to the respective parcels of property by means of the improvements in the unit upon which the particular property abuts, the regularity of the proceedings with reference to such improvements, the apportionment of the cost of such improvements, and other matters and things will be determined, and after such hearings assessments will by ordinance be made and levied, and such hearing will be had and held by and before the City Commission of the City of Lubbock, Texas, in regular Commission meeting room in the City Hall, in the City of Lubbock, Texas on the loth day of April, 1952, at 2:00 P.M. o'clock. The rolls or statements showing the proposed amounts of such assessments are on file in the office of the City Secretary and copies thereof are in the office of the City Engineer of the City of Lubbock and open to inspection of any interested parties at any time, and of all said matters and things all such owners of property, as well as any and others in anywise affected or interested, will take due notice. By order of the City Commission of the City of Lubbock, this the 27th day of March, 1952. No notice other than that hereinabove provided for shall be necessary but publication of such notice shall be due and sufficient notice to any and all persons, firms, corporations and other parties. III. That a hearing be given and held by and before the Governing Body of the �- City of Lubbock, Texas, to all persons owning or claiming any property abutting any part or portion of said College Avenue and Erskine Street described in Section II, of this Resolution, as well as all owning or claiming any interest in any such property. Such hearing shall be given and held on the loth day of April, i 1952, at 2:00 P.M. otclock on the first floor in the City Hall, City of Lubbock, 02,21 " r� Texas and the City Secretary is hereby directed to give notice of the time and place of such hearing, and of other matters and facts in accordance with the terms and provisions of an Act passed at the first called session of the 40th Legislature of the State of Texas and known as Chapter 106 of the Acts of said Legislature which has been adopted as an amendment to and made a part of the Charter of the City of Lubbock, Texas, and as amended by Chapter 281 Acts of the 52nd Regular Session of said Legislature. Such notice shall be by advertisement inserted at least three times in a newspaper published in the City of Lubbock, Texas; th9 first publication shall be made at least ten days before the said hearing, Said notice shall comply with and be in accordance with the terms and provisions of this resolution and said Act as amended, PASSED MTD APPROVED BY UNAATIMOUS VOTE OF THE GOVERNING BODY OF THE CITY C]F LUBBOCK, TEXAS, THIS, THE 27TH DAY OF MARCH, 1952.
