HomeMy WebLinkAboutResolution - 032752A - Prepare Paving Estimates, Etc. - City Engineer - 34Th Street, GWO 661 - 03_27_1952 GWO 661 RES OLUT I01T RESOLUTION APPROVING AND ADOPTING ESTIMATE OF THE COST OF 111PROVEMENTS, OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS IF THE NATURE OF GRADING, LAYING CURB AND GUTTER AT-0 PAVING 34TH STREET FROM INDIANA AVENUE TO QUA ER AVENUE IP+ THE CITY OF LUBBOCK, TEXAS, SAID IMPROVEMENTS BEING DESIGNATED AS GWO N0.661, FIXING THE TDIE AND PLACE FOR A HEARING TO THE OIMERS OF ABUTTING PROPERTY, AND OTHER PERSONS INTERESTED IN SAID PROPERTY AND DIRECTING THE CITY SECRETARY TO PUBLISH NOTICE ON BEHALF OF THE, GOVERNING BODY OF THE CITY OF LUBBOCK,. TEXAS. WHEREAS, the Governing Body of the City of Lubbock has heretofore ordered that 34th street from West Property Line of Indiana Avenue to the West Property Line of Quaker Avenue be improved by grading, installing concrete curb and gutter and paving with caliche base and quadruple asphalt surface together with incidentals and appurtenances and arrangements therefore have been made and entered into by the City of Lubbock, Texas with J. R. Fanning, Contractor, and, WHEREAS, the Governing Body of the City of Lubbock has caused the City Engineer to prepare and file estimates of the cost of such improvements and estimates of the amounts per front foot to be assessed against abutting property and the owners thereof, and such estimates have been prepared and examined; r THEREFORE, BE IT RESOLVED BY THE CITY COMPISSION CIF THE CITY OF LUBBOCK, TEXAS, THAT I. Such estimates be and they are hereby adopted and approved. II, NOTICE TO THE (MVERS OF PROPERTY ABV!'TING UPON THE HEREIMLO14 MENTIONED PORTIONS OF 34TH STREET AND TO ALL OTHERS AFFECTED: The Governing Body of the City of Lubbock has heretofore ordered that the following portions of 34th Street in the said City of Lubbock, Texas, be improved by raising, grading and filling and installing concrete curbs and gutter and storm sewers and drains where necessary on the portions of 34th Street, designated below: It is hereby found and determined that the cost of improvements on such portions of said 34th Street with the amount or amounts per front foot proposed tor. be assessed for such improvements against the abutting property and the owners thereof, on the portions of said 34th Street are as follows, to-wit: 34th Street from its intersection with the West Property Line of Indiana Avenue to its intersection with the East Property Line of Joliet Avenue, known and designated as Unit Number 1345; the estimated cost of improvements is Z8,977.54; the estimated amount per front foot to be assessed against the abutting property and owners thereof for curb is 00.55; the estimated amount per front foot to be assessed against the abutting property lying in "A" and "B" zones and the owners thereof for improvements exclusive of curb is 33.36; the estimated amount per front foot to be assessed against the abutting property lying in all zones other than "A" and "B" and the owners thereof for improvements exclusive of curb is $5.7 . 34th Street from its intersection with the West Property Line of Joliet Avenue to its intersection with the West Property. Line of Louisville Avenue, known and designated as Unit Number 1346; the estimated cost of improvements is $18,793.17; the estimated amount per front foot to be assessed against the abutting property and owners thereof for curb is 30.55; the estimated amount per front foot to be assessed against the abutting property lying in "A" and "B" zones and the owners thereof for improvements exclusive of curb is $3.36; the estimated amount per front foot to be assessed against the abutting property lying in all zones other than "A" and "B" and the owners thereof for improvements exclusive of curb is $5.77. 34th Street from its intersection with West Property Line of Louisville Avenue to its intersection with the West Property Line of Nashville Avenue, known and designated as Unit Number 1347; the estimated cost of improvements is 18,635.98; the estimated amount per front foot to be assessed against the abutting property and owners thereof for curb is $0.55; the estimated amount per front foot to be assessed the abutting property lying in "A" and "B" zones and the owners thereof for improvements exclusive of curb is Z3.36; the estimated amount per front foot to be assessed property lying in all zones other than "A" and. "B" and the owners thereof for improvements exclusive of curb is 05.77. 34th Street from its intersection with the West Property Line of Nashville Avenue to its intersection with the West Property Line of Quaker Avenue, known and designated as Unit Number 1348; the estimated cost of improvements is $24,717.44; the estimated amount per front foot to be assessed against abutting property with no existing curb and gutter and the owners thereof for curb is =?0.55; there is to be no assessment of '0.55 per front foot for curb against abutting property in this unit which has existing curb and gutter in place; the estimated amount per front foot to be assessed against abutting property lying in "All and "BIT zones with'no existing curb and gutter and the owners thereof for improvements exclusive of curb is $3.36; the estimated amount per front foot to be assessed against abutting property lying in all zones other than "A" and "B" with no existing curb and gutter and the owners thereof for improvements exclusive of curb is 05.77; the estimated amount per front foot to be assessed against abutting property lying in "A" and "B" zones with existing curb and gutter in place and the owners thereof for improvements exclusive of curb is Z2.41; the estimated amount per front foot to be assessed against abutting property lying in all zones other than "A" and "BIT with existing curb and gutter in place and the owners thereof for improvements exclusive of curb is $4.82. ISO A6 And arrangement for the making and construction of such improvements with pavement of quadru le course asphalt surface treatment (Inverted Penetra— tion Type) and a Six (65 Inch compacted caliche base, has been made and entered into by the City of Lubbock, Texas, with J. R. Fanning, Contractor, and rolls or statements showing the proposed amounts to be assessed against abutting proper— ty and the owners thereof have been filed with the City, such rolls or statements showing other matters and things, and have been approved and the City Commission of said City has fixed a time and place for hearing to the owners of property abutting upon said portions of 34th Street and to all others affected, at which hearing the amounts to be assessed against the respective parcels of abutting land and the owners thereof for improvements in the units upon which the particular parcels of property abut, the amounts of benefits to the respective parcels of property by means of the improvements in the unit upon which the particular property abuts, the regularity of the proceedings with reference to such improvements, the apportion=nt of the cost of such improvements, and other matters and things will be determined, and after such hearings assessments will by ordinance be made and levied, and such hearing will be had and held by and before the City Commission of the City of Lubbock, Texas, in regular Commission meeting room in the City Hall, in the City of Lubbock, Texas on the loth day of April 1952, at 2:00 P.M. o1clock. The rolls or statements showing the proposed amounts of such assessments are on file in the office of the City Secretary and copies thereof are in tha office of the City Engineer of the City of Lubbock and open to inspection of any interested parties at any time, and of all said matters and things all such owners of property, as well as any and others in anywise affected or interested, will take due notice. By order of the City Commission of the City of Lubbock, this the 27th day of March, 1952. No notice other than that herainabove provided for shall be necessary but publication of such notice shall be due and sufficient notice to any and all persons, firms, corporations and other parties. III. That a hearing be given and held by and before the Governing Body of the City of Lubbock, Texas, to all persons owning or claiming any property abutting any part or portion of said portions of 34th Street described in Section II, of this Resolution, as well as all owning or claiming any interest in any such property. Such hearing shall be given and held on the loth day of April 1952, at 2:00 P.M. o'clock on the first floor in the City Hall, City of Lubbock, Texas and the City Secretary i_s hereby directed to give notice of the time and place of such hearing, and of other matters and facts in accordance with the terms and provisions of an Act passed at the first called session of the 40th Legislature of the State of Texas and known as Chapter 106 of the Acts of said Legislature which has been adopted as an amendment to and made a part of the Charter of the City of Lubbock, Texas, and as amended by Chapter 281 Acts of the 52nd Regular Session of said Legislature. Such notice shall be by advertisement inserted at least three times in a newspaper published in the City of Lubbock, Texas; the first publication shall be made at least ten days ^ before the said hearing.
