" -`, �1 ILA-to �?s t4XtiA All ,dI - f 40� EXHIBIT A R E S O L U T I O N (Adopted by unanimous vote at a regular meeting of the Lubbock Civil Service) (Commission, held October 3, 1951, upon motion by Commissioner Justice, Sec-) (onded by Commissioner Watkins. ) WHEREAS.. the 52nd Texas Legislature, Acts 1951, Page 1+25, Chapter 265, amended Section 28 of Article 1269m, Revised Civil Statutes, relating to Firemen's and Policemen's Civil Service in cities of 10,000 or more inhab- itants, by adding thereto Section 28(a), the complete text of which is attached hereto and made a part hereof under the designation of Exhibit Atl ; and, WHEREAS.. said amendment, upon recommendation by the Civil Service Com- mission and approval by the governing body and subject to certain stipulated conditions and restrictions, permits and authorizes the appointment of per- sons over the age of 35 years to fill vacancies in the Fire and Police De- partments; and, AS, the Civil Service Commission of the City of Lubbock has caused an investigation to be made regarding economic and employment conditions in the City of Lubbock and vicinity, and finds same to be:auch as to make im- possible the recruiting of qualified employees for vacancies in the Fire and Police Departments who are under 35 years of age, and that this condi- tion constitutes an emergency; MY THEREFORE, BE IT RESOLVED AND R.ECOMENDED, by the Lubbock Civil Service Commission, that the provisions and benefits of the foregoing amendment be made available to and operative in the Fire and Police Departments of the City of Lubbock, Texas, subject to the following donditions: (a) Authority of a department to make appointments under the provi- sions of the foregoing amendment and this resolution shall be obtained by means of written request filed by the department r -2- ' head with the Civil Service Commission, briefly stating reasons for same; (b) The Commission may grant, refuse or rescind such authority to either or both the Fire and Police Departments, independently and without prejudice; (c) A11 provisions of the Firemen's and Policemen's Civil Service Rules for the City of Lubbock with regard to educational and written examination requirements are hereby suspended and waived only with regard to appointments made hereunder; (d) 41iih the exception set forth under (c) above and the provisions of the amendment in question, all appointees hereunder shall be subject to the provisions of the Firemen's and Policemen's Civil Service Rules for the City of Lubbock and to the Rules of the department in which the appointment is effective. (e) Selection of appointees hereunder shall be at the discretion of the head of the department, subject to review and approval by the Commission.
