Sullivan Et Al- Lots 2-7 Block 14 Original Town - 09_28_1951 * ltil l r, RESOLUTION ra WHEREAS, on the 2d day of June, W, Captain Ed W. Sullivan of Port Isabel, Texas, owner of a certain interest in Lots Two (2), Three (3), Four (4), Five (5), Six (6), and Seven (7), .Block Fourteen (14), Original Town of Lubbock, Lubbock County, Texas, was sent two alternatives concern- ing the extension of 4th Street across his property immediately West of Avenue A-U. S. Highway 87, and a proposal in the amount of $1, 887.50 was submitted by the Right-of-Way Agent of the City of Lubbock, executed by Ed W. Sullivan and wife, Mrs. Ed W. Sullivan, and F. W. Dooley, all inter- ested parties in the lots herein named, and, WHEREAS, the proposal was never accepted by the City Commission, and, WHEREAS, the certain tax lien foreclosure proceedings in the chain of title are defective, and for the City of Lubbock to acquire merchantable fee simple title it will be necessary to condemn the hereinafter described tract of land, NOW, 'THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION F THE CITY LUBBOCK/ O O T OF L O K. THAT the City Attorney BE, and he is hereby authorized and directed U n��Jr % to institute condemnation proceedings on behalf of the City of Lubbock to acquire the tract of land hereinafter described for the 4th Street Right-of-Way purposes, said tract to be condemned lying and situated in Lubbock County, Texas, described as follow, to-wit: BEGINNING at the Northwest corner of Lot Two (2), Block Fourteen (14), Original Town of the City of Lubbock, Lubbock County, .Texas; THENCE Easterly with the North line of said Lot Two (2) a distance of 5, 33 feet more or less to a point in the Northerly right-of-way line of Fourth Street highway align- ment; ; 'HENCE Southeasterly with. the said North right-of-way line across Lots Two (2) and Three (3), Block Fourteen (14), a distance of 125.44 feet more or less to a point on the West boundary of the North-South alley in said Block Fourteen (14); THENCE Southerly with the said West'boundary of said alley in Block Fourteen (14) a distance of 94. 33 feet more or leas to a point, said point being the intersection of the South right- of-way line of said Fourth Street alignment and the West boundary of said alley; THENCE Northwesterly with the said South right-of-way line of Fourth Street alignment across Lots Seven (7), Six (6), and Five`(5)'of said Block Fourteen (14) a distance of 131. 03 feet, more or ',less, to a point, said point being the intersection of the said South right-of-way line of Fourth Street alignment and the East property line of Avenue C; THENCE Northerly with the East property line of Avenue C a distance of 94. 33 feet,' more or less, to the point of beginning,: and containing 11, 792: 7 square feet. 1 0q28QIF On motion of Commissioner Davis seconded by Com- missioner Thomas this Resolution was unanimously passed this the 28th day of September ' 1951, by the following vote of the City Commission: { Commissioners voting "Yea": Hufstedler, Davis, 'Thomas and hhyor Whiteside Commissioners voting "Nay": none _ Mayo r ATTEST: 1 .
