RESOLUTION 15
WHEREAS, the City Commission has heretofore authorized joint action
by the City of Lubbock and the County of Lubbock inAhe ,acquisition of right-of-
way for East 19th Street, and in addition thereto access roads, and it has been
determined that Alex McDonald and others own or have an interest in the
property described in this Resolution, and various offers have been made to
t e owners, which offers have been refused, and this Commission is of the
o�inion that the offers for the separate tracts of land!herein described are
equitable and any further effort to attempt to agree *ith said owners upon the
value of 1he land and damages would be futile, and,
WHEREAS, the City Commission finds that acquisition either by pur-
chase or condemnation is necessary in the public interest in connection with
the extension, widening and construction of East 19thjStreet, 'which involves
also the construction of an underpass beneath existing Santa Fe''.tracks, and
that the acquisition of said tracts of land is necessary to promote public
safety and welfare, THEREFORE,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CIT71 OF LUBBOCK:
6 THAT, the City of Lubbock join with the County of Lubbock in the
acquisition of certain tracts of land situated partly w4hin and' partly outside
the- corporate limits of the City of Lubbock, said tracts of land being described
and situated as follows, to-wit:

The Right-of-Way.Agent for the City of Lubbock is authorized to o fer
Alex'McDonald and all other persons having an interest in Tract 1-A the sum
of Four Hundred ;.Dollars ($400)'for a Permanent Easement, and the sum of
One Hundred Dollars ($100) for a Temporary, Easement to Tract Z-•,A for a
period of time not exceeding two (Z) .years from January 1, 1952, for a con-
struction by-pass road.
The offers above authorized are to be made promptly by the Right-of-
Way Agent, and in the event the same are not accepted, the City Attorney is
authorized and directed to immediately file condemnation' s uits and any other
actions which may be necessary or advisable in acquiring easements for
highway right-of-way purposes at the earliest practicable time; and in this
connection the City Commission further finds that unless said, owners accept
the offers here authorized, that any further effort to agree �on,the purchase
price for such easements would be futile.
On motion of Commissioner Davis , ,seconded by
Commissioner Hufstedler this Resolution was unanimously passed
this 24th day of September , 1951, by the following vote of the City
Commission:
