' '►' RESOLUTION
�..� WHEREAS, the City Commission has heretofore authorized the payment
of Five Thousand Dollars ($5, 000. 00) as part of the purchase price of tracts of
land hereinafter described from Alex McDonald, the owner, said purchase price
to be Twelve Thousand Dollars ($12, 000. 00), the balance to be paid by 'Lubbock
County, as agreed between the City and the County, such offer to b,e shade
jointly by an agent of the City and the County in order to secure said tracts of
land from the owner to be used for right-off-way purposes on East 19th Street
and for an access road leading from East 19th Street into the area,just South
of 19th Street and East of the main line of the Pecos and Northern Texas
Railway Company, and,
WHEREAS, on behalf of the County of Lubbock and the, City of Lubbock
jointly, such agent has made the oint offer of Twelve Thousand Dollars
� ($12, 000. 00) to Alex McDonald for said tracts of land, which offer was rejected
by Alex McDonald, and the City Commission and Commissioners Court are of

the opinion that an .further effort to wath Alex McDonald on th
�7 the land to be acquired, and damages, would be futile, and such joi4lleffort
was and is necessary due to the fact that a part of the real estate to Abe acquired
is in a single tract, a part of which lies within and a part beyond the corporate
limits of the City of Lubbock, THEREFORE,
BE IT RESOLVED BY THE CITY COMMISSION OF THE.CITY OF LUBBOCK:
THAT the City Attorney BE, and he is hereby authorized and directed,
together with the attorney representing Lubbock County, to institute condemna-
tion proceedings on behalf of the City and the County to acquire the ;tracts of
land hereinafter described for East 19th Street right-of-way purposes' and an
access road into the remaining part of the tracts of land owned by Alex, McDonal
and out of which tracts this right-of-way is being secured, said tracts It be
condemned being situated in Lubbock County, Texas, and described as follows:
TRACT-I, , Portion of Alex McDonald Property required for the 19th
Street Highway Right-of-Way: A tract of land out of the 1. 21 acre
tract conveyed by the Pecos and Northern Texas Railway Company
to Alex McDonald on June 15,- 1935, and recorded in•Volume 192,
page 61, of the Deed Records of Lubbock County, and being Ldes'cribed
as follows:
BEGINNING at the point of intersection of the North line of Section
Five (5), Block B, and a line parallel to and 137. 5 feet. Northeasterly
from, measured at right angles to the centerline of the main track of
the railroad; THENCE Southeasterly,parallel to said main track center-
line a distance of 84,5 feet; THENCE East along a line sixtyfive (65)
feet from and parallel to the North line of Section Five (5) a;distance
of 130 feet to the East property line; THENCE,Northwesterly parallel
to said main track centerline 84. 5 feet to the North line of Section
Five (5); THENCE West along the North line of Section Five (5), a
distance of 130 feet to the point of beginning; and containing 0.194
acre.

A tract of land out of the 1. 21 acre tract conveyed by the Pecos and
Northern Texas Railway Company to Alex McDonald on June 15, 1935,
and.recorded in Volume 192, page 61, of the Deed Records of Lubbock
County, and being described as follows:
BEGINNING at the point of intersection of the North line of Section
Five (5), Block B, and a line parallel to and 137.5 feet northeasterly
from, measured at right angles to the centerline of the main track of
the Panhandle & Santa Fe Railway, said point of beginning being
1281. 3 feet more or less East of the Northwest corner of Section
Five (5); THENCE Southeasterly along a line parallel to said main
track a distance of approximately 84. 5 feet more or less to its
intersection with'a line sixty-five (65) feet distant from, and parallel
to the North line of Section Five (5); THENCE .East 79.9 feet more
or less along a line parallel to and sixty-five (65) feet distant from
the North line of Section Five (5) to a point; THENCE Northwesterly
along a line parallel to the main track of the Panhandle and Santa Fe
Railway and along the City Limit Line a distance of approximately
84.5 feet more or less to a point on the North line of Section Five (5)
and the North line of this tract; THENCE West along the North line of
Section Five (5) and the North line of this tract a distance of 79.9
feet to the point of beginning, and containing 0. 155 acres, more or
less.
TRACT I-b, Portion of Alex McDonald Property required for 19th
Street Iighway Right-of-Way OUTSIDE City Limits of Lubbock, Texas:
A tract of land out of the 1. 21 acre tract conveyed by the Pecos and
Northern Texas Railway Company to Alex McDonald on June 15, 1935,
and recorded in Volume 192, page 61, of the Deed Records of Lubbock
County, and being described as follows:
BEGINNING at the point of intersection of the North line of Section
Five (5), Block B, and the existing City Limit Line, which point is
1361. 2 feet East of the Northwest corner of Section Five (5); THENCE
Southeasterly along a line parallel to the main track of the .Panhandle
& Santa Fe Railway a distance of approximately 84.5 feet more or
less to the intersection with an East-West line parallel to and sixty-
five (65) feet distant from the. North line of Section Five (5); THENCE
East along a line parallel to and sixty-five (65) feet distant from the
North line of Section Five (5) a distance of 50. l feet to a point in the
East line of the Alex McDonald Tract; THENCE Northwesterly on a
line parallel to the main track of the Panhandle & Santa Fe Railway
a distance of approximately 84.5'feet more or less to a point in the
North line of Section Five (5) THENCE West a distance of 50. 1 feet

beginning, and containing 0.097 acres, more or less.

West property line crossing the highway centerline at fifty (50)

service road 351.`5 feet to the South right-of-way line of proposed

and being described as follows:
BEGINNING at a point in the North line of Section Five (5), Block
B, 2495. 8 feet West of the Northeast corner of Section Five (5),
the said point being the Northeast corner of the Alex .McDonald
6.344 acre tract; THENCE West along the North ,line of Section
Five (5), 1084. 5 feet to the Northwest corner of the Alex McDonald
Tract; THENCE South 170 151 East along the West property line

Commissioner Thomas this Resolution was unanimously
passed this 28th ay of August, 1951, by the City Commission by the following
vote:
