HomeMy WebLinkAboutResolution - 4733 - CO #1 To Contract- PVI Insutries Inc- Emergency Repairs, Boiler #2, Holly Plant - 02_08_1995Resolution No. 4733 February 9, 1995 Item #18 RESOLUTION WHEREAS, the City of Lubbock heretofore entered into an agreement with PVI Industries, Inc., of Fort Worth, Texas, for replacement of boiler tube panels for Holly Plant Boiler No. 2, which had become unreliable due to tube leaks; and WHEREAS, LP&L received bids requiring repairs to be completed no later than April 29, 1994; and WHEREAS, the delivery of the required tube panels was delayed by labor disputes (trucking strike on the East Coast) and actual delivery of the materials was not complete until May 30, 1994; and WHEREAS, the tubing panels as received had suffered unforeseen damage in shipment and also had insufficient fin setback, which required the Contractor to stay on site approximately five weeks longer than anticipated; and WHEREAS, due to the near proximity of summer peak load requirements creating an emergency situation, since it was critical that both boilers be available to prevent power outages that could result in dangers to the health and safety of the citizens of the City of Lubbock, including failure of traffic signals, critical health care equipment and air conditioning; and WHEREAS, such repairs were necessitated by an unforeseen damage to City equipment due to shipping damage and insufficient fin setback; and WHEREAS, since time was of the essence, such repairs were made as an emergency measure and the project was not rebid as is ordinarily required for change orders exceeding 25 percent of the original contract price; and WHEREAS, the City Council of the City of Lubbock hereby authorizes, approves and ratifies the attached Change Order No. 1 to Bid No. 12824 by PVI Industries, Inc., as an emergency measure; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the City Council hereby authorizes, approves and ratifies the attached Change Order No. 1 to Bid No. 12824 by PVI Industries, Inc., for emergency boiler repairs to Holly Plant Boiler No. 2 and the Mayor of the City of Lubbock is hereby authorized and directed to execute such Change Order No. 1 in the amount of $70,385.77 on behalf of the City of Lubbock. f%-L T _L ___ _ _ ___ _ Passed by the City Council this ATTEST: &d'- tk betty M. Box 7124 Fort Worth, TX 76111 Original Amount of Contract Amount of Previous Change Orders Net Amount of this Change Order Amended Amount of this Contract Percentage Change of Contract Price is Additional Time of Completion is Date of Substantial Completion of this Change Order is complete . $129,893.00 0.00 70,385.77 $200,278.77 35% 35 days WHEREAS, due to unforeseen damage to City equipment, delay in receiving spare parts due to labor disputes (trucking strike) and in order to protect the health and safety of the citizens of the City of Lubbock, it is desirable to make changes in the plans and specifications for this project; and WHEREAS, such unforeseen damage to City equipment, unavoidable delays and the immediate threat to the health and safety of the citizens of the City of Lubbock, require that this change order be issued as an emergency measure without rebidding said project. NOW THEREFORE, the Contractor shall furnish all labor and material to repair boiler panels back to Code. 3 IN WITNESS WHEREOF, the Owner and the Contractor have hereto set their hands this 9th day of February , 1995.
