HomeMy WebLinkAboutResolution - 020851F - Street Improvements - City Engineer - 34Th Street - 02_08_1951 RESOLUTION RESOLUTION PROVIDIKG FOR IMPROVEMENT OF PORTIONS OF 34TH STREET IN THE CITY OF LUBBOCK, TEXAS, AND DIRECTING PREPARATION OF PLANS AND SPECIFICATIONS BE IT RESOLVED BY THE CITY COMISSION OF LUBBOCK, TEXAS: r THAT, Public necessity exists that the following portions of 34th Street be improved as herein provided, to wit: from Avenue H to Avenue X from Boston Avenue to Indiana Avenue II Said portions of 34th Street shall be improved by raising, grading, and filling same, and by installing concrete curbs and gutters and storm sewers and drains where necessary., and by paving 64 feet wide with guadruple asphalt surface treatment ( Penetration type ).- III The City Engineer is hereby directed to prepare plans and specifications for such improvements. IV Such improvements in each Unit shall be paid for in the following manner. (a) Railways using, occupying., or crossing any portion of 34th Street to be improved shall pay for and be assessed for all the cost of work in the area between their rail and tracks, double tracks, turnouts., and switches and two feet on each side thereof. (b) In zones designated "A and B" by the City Commission the property owners will pay the property owner. curb cost at fifty—five cents per foot and up to 90% of the estimated cost of paving 34th Street with a 30 foot pavement. The City and County will share equally the rest of the cost of constructing a 64 foot pavement on 34th Street, less 5% Engineering Cost., as shown on the plans. In all zones other than "A and B" the City and County each will pay 14.-595 % of the cost, less property owner curb . of constructing the 641 pride j paving improvements on 34th Street and the abutting property and owners thereof will be assessed for the rest of the cost. 5% for engineering will be deducted from the Cityts share. V The amounts to be paid by and assessed against railways and street railways for work between the rails and tracks and two feet on each side thereof shall be r- paid on estimates or statements on or before ten days after .completion of the work and shall bear interest from date due and until paid at the rate of 6 percent perannum. The amounts to be assessed against and paid by abutting property and the owners thereof in each Unit shall be payable in three equal installments due respectively on or before ten days, 1, and 2 years after the completion and acceptance by the City of the improvements in the Unit upon which the property abuts, and shall bear interest from date of such completion and acceptance and until paid at the rate of six percent perannum� payable annually, with provision that if default be made in the payment of any installment-,,:promptly as the same mat- ures., then at the option of the holder of any such assessment or certificate issu in evidence thereof, such default shall mature the entire assessment upon which same is made. VI Assessments. shall be made and levied and shall be a first and prior lien and personal liability for principal, interest, reasonable attorney's fees and costs of collection, if incurred, all under and in accordance with the Charter., and amendments thereto, now in force in this City.
