WMEAS, on January 17, 1951, as shown by the minutes of the City Commission
of the City of Lubbock, the City Commission approved an appraisal of the followin
described property: "Beginning at the Northwest corner of Lot 8, Block 17,
Wheelock Second Addition to the City of Lubbock, Lubbock County, Texas; Thence
South 58.32 feet to a point; ,,Thence Southeasterly to a point in the East Property
Line of said Lot 8, aforesaid, said point being 64.15 feet South of the North-
east corner of said Lot 8, aforesaid; Thence North 64-15 feet; Thence West 50
feet to the point of beginning", being off'the North side of Lot 8, Block 17,
Wheelock Second Addition to the City of Lubbeek, Lubbock County, Texas, totaling
E875.00, and by resolution of the same date authorized the Right-of-4ay Agent
to offer said amount to Josia A. Smith for the above described parcel of land
of said Lot, and all damages occasioned by the proposed widening of 19th Street
between Avenue Hand the Panhandle & Santa Fe Main Line Track, and,
WHEREAS, the appraisers, Glen Hess, Wiley- Puckett and Ii Robert W. Wright
have found that they were in error in appraising said property for the reason
that they did not consider the residual damage to the property, and,
MEREAS, a new appraisal has been made.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMSSION OF THE CITY CF LUBBOCK,
TEXAS:
THAT, the resolution authorizing the offer as set out in the preamble hereto
is hereby in all things revoked and authority to make that offer is cancelled and
by virtue of said resolution and the approval of said appraisal, no offer shall
be made by the Right-of-Way Agent and the minutes above referred to shall be
corrected and interlined by the City Secretary to show the cancellation of such
authority and revokation of the resolution insofar as the same affects the propert
above described and set out in the preamble hereto.
On motion of Commissioner ffutl3t=_ler , seconded by Commissioner
Davis , the foregoing resolution was passed by the following vote:
Commissioners voting AYE: for Whiteside, Hufstedler,
and Thomas
Commissioners voting NAY: None ,
this day of February, 1951.
