HomeMy WebLinkAboutResolution - 101250I - Street Improvements - GWO 572 - 10_12_1950 hA RESOLUTION 101 3: A RESOLUTION APPROVING AND ADOPTING ESTIMATE OF THE COST OF IMPROVEMENTS " IN THE NATURE OF GRADING, LAYING CURB AND GUTTER AND PAVING PORTIONS OF CERTAIN STREETS, AVENUES, AND/OR ALLEYS IN THE CITY OF LUBBOCK, TEXAS, SAID IMPROVEMENTS BEING DESIGNATED AS GWO NO.572, FIXING THE TIME: AND PLACE FOR A HEARING, TO THE OWNERS OF ABUTTING PROPERTY, AND OTHER PERSONS INTERESTED IN SAID PROPERTY, AND DIRECTING THE PUBLICATION OF NOTICE OF SAID HEARING. WAS, the Governing Body of the City of Lubbock has caused the City Engineer to prepare and file estimate of the cost of improving certain portions of streets, avenues, and/or alleys described in General Work Order No. 572, showing the amounts per front foot proposed to be assessed against abutting property and the owners thereof, and such estimates have been prepared and examined: THEREFORE, BE IT RESOLVED BY THE CITY COMSSION OF LUBBOCK, TEXAS: SECTION L. THAT, such estimates be and the same are hereby approved and adopted. SECTION 2. THAT, a hearing shall be held on the,27th day of October,1950, at 1:30 otclock, in the City Commission room at the City Hall, Lubbock, Texas, to the owners of abutting property and other persons interested in property, described in.the notice, at which hearing the amounts to be assessed against the respective parcels of abutting land and the owners thereof for improvements in the units which the particular parcels abut, the amounts of benefits to the respective parcels of property by means of the improvement in the unit upon which the particular property abuts, the regularity of the proceedings with reference to such improvements, the apportionment of the cost of such improvements, and other matters and things will be determined. SECTION 3. THAT, the Mayor and City Secretary be and are hereby authorized and directed to publish a notice of a hearing to the owners of abutting property and all persons interested, at least three (3) times in some newspaper published in the City, the first publication to be made at least ten (10) days before the date of hearing. Such notice shall state the portions of streets, avenues, and/or alleys to be improved and the amount proposed to be assessed against property abutting thereon and the owners thereof, the amounts to be assessed against railways and street railways and the total cost of each unit. Such notice shall be sufficient, valid and binding upon all owning, or claiming abutting property in units described in notice, or any interest therein, and Non all owning or claiming such railways, street railways, or interurbans, in units -described in notice, or any interest therein. 4,t+uP c � .. ,€. � ,•.� a,, .,4. :< SECTION 4. The Governing Body of the City of Lubbock has heretofore7ordered that the following portions of streets, avenues and/or alleys in said City of Lubbock, Texas, be improved by raising, grading and filling, installing concrete curbs and gutters, and installing storm sewers and drains where necessary and paving. The City Engineer has determined that the amounts to be assessed against the following portions of streets, avenues and/or alleys are to be determined from the rates stated below. Elgin Avenue from its intersection with the South Paving Line of 34th Street to its intersection with the North Property Line of 36th Street, known and designated as Unit Number 1077, the estimated cost of improvements is $4f6".62; the estimat- ed amount per front foot to be assessed against the abutting property and owners thereof for curb is $0.55; the estimated amount per front foot to be assessed against the abutting property and owners thereof for improvements exclusive of curb is $3.64, for front abutting property and $2.42, for side abutting property. Elgin Avenue from its intersection with the South Property Line of 36th Street to its intersection with the North Property Line of 39th Street, known and desig- nated as Unit Number 1078, the estimated cost of improvements is $7,383.44; the estimated amount per front foot to be assessed against the abutting property and owners thereof for curb is $0.55; the estimated amount per front foot to be assessed against the abutting property and owners thereof for improvements ex- clusive of curb is $3.61, for front abutting property and $2.40, for side abutting property. And arrangement for the making and construction of such improvements with pavement of quadruple course asphalt surface treatment (Inverted Penetration Type) on a Six (6) Inch compacted caliche base for streets & Avenues and 5 WtIll- concrete pavement for alleys, has been made and entered into by the City of Lubbock, Texas, with Warren & Purtell, Inc. Contractor, and rolls or statement showing the proposed amounts to be assessed against abutting property and the owners thereof have been filed with the City, such rolls or statements showing other matters and things, and have been approved, and the City Commission of said City has fixed a time and place for hearing to the owners of property abutting upon said portions of streets, avenues End/or alleys, and to all others affected, at which hearing the amounts to be assessed against the respective parcels of abutting land and the owners thereof for improvements in the units upon which the particular parcels of property abut, the amounts of benefits to the respective parcels of property by means of the improvements in the unit upon which the par- ticular property abuts, the regularity of the proceedings with reference to such improvements, the apportionment of the cost of such improvements, and other matter and things will be determined, and after such hearings assessments will by ordinance be made and levied, and such hearing will be had and held by and before the City Commission of the City of Lubbock, Texas, in regular Commission meeting I 1012 room in the City Hall, in the City of Lubbock, Texas, on the 27th day of 06ttober, 1950, at 1:90 P. M. Otclock. The rolls or statements showing the propose amounts of such assessments are on file in the office of the City Secretary and Qbpies hereof are in the office of the City Engineer of the City of Lubbock and open to inspection of any interested parties at any time, and of all said ' tatters and things all such owners of property, as well as any and others in °anywise effected or interested, will take due notice. By order of the City Commission of the City of Lubbock, this 12th day of October, I950.
