HomeMy WebLinkAboutResolution - 052550I - Street Improvements - COL Contractor - GWO 543 - 05_25_1950 RESOLUTION RESOLUTION APPROVING AND ADOPTING ESTIMATE OF THE COST OF IMPRITS OF AMOUNTS TO BE ASSESSED FQR IMPROVEMENTS IN THE NATURE OF GRADING., LAYING CURB AND GUTTER AND PAVING PORTIONS OF CERTAIN STREETS, AVENUES AND/CR ALLEYS IN THE CITY OF LUBBOCK, TEXAS, SAID MPROVEMENTS BEING DESIGNATED AS GWO NO.543, FIXING THE TIME AND PLACE FOR NEARING TO THE OWNERS OF ABUTTING PROPERTY$ AND OTHER PERSONS INTERESTED IN SAID PROPERTY AND DIRECTING THE CITY SECRETARY TO PUBLISH NOTICE OR BEHALF OF THE GOVERNING BODY OF THE CITY OF LUBBOCK, TEXAS: WHEREAS, the Governing Body of the City of Lubbock has heretofore ordered-that portions of the streets, avenues and alleys be 'improved by grading, installing concrete curb and gutter and paving Frith caliche base and quadruple asphalt surface together with incidentals and appurtenances.. and arrangements therefore have been made and entered into by the City of Lubbock, Texas ,Contractor, and, WHEREAS, the Governing Body of the City of Lubbock, has caused the City Engineer to prepare and file estimates of the cost of such improvements and estimates of the amounts pAr front foot proposed to be assessed against abutting property and the owners thereof, and such estimates have been Vrepared and examined; THEM QRE, BE IT RESOLVED BY THE CITY CONMISSION OF THE CITY OF LUBBOC , TEXAS 1. And arrangement for the making and construction fo such improvements with pave— ment of quadruple course asphalt surface treatment (Inverted Penetration Type) of a .- Six (6) Inch compacted caliche base has been made and entered into by the City of Lubbock, Texas, and rolls or statement showing the proposed amounts to be assessed against abutting property and the owners thereof have been filed with the city, such rolls or statements showing other matters and things, and have been approved and the City Commission of said City has fixed a time and place for hearing to the owners of property abutting upon said portions of streets, avenues and/or alleys, and to all others affected, at which hearing the amounts to be assessed against the respective parcels of abutting land and the owners thereof for"improvements in theunits upon which the particular parcels of property abut, the'amounts of benefits to the res— pective parcels of property by means of the improvements in the unit upon which the particular property abuts, the regularity of the proceedings with reference to such improvements, the apportionment of the cost of such improvements, and other matters and things will be determined, and after such hearings assessments will by ordinance be made and levied, and such hearing will be had and held by and before the City Commission of the City of Lubbock, Texas, in regular Commission Weting room in the City Hall, in the City of Lubbock, Texas on the day of < < y V_1950, at P.M. o'clock. The rolls or statements showing the proposed amounts of such assessements are on file in the office of the City Secretary and copies thereof are in the office of the City Engineer of the City of Lubbock and open to inspection of any interested parties at any time, and of all said matters and things all such owners of property, as well as any and others in any wise affected or interested, wi 1 take due notice. By Order of the City Commission of the City of Lubbock, this day of ,_ 1950. No notice other than that hereinabove provided for shall be necessary, but pub— lication of such notice shall be due and sufficient notice to any and all persons, firms, corporations and other parties. 'r^ III That a hearing be given and held by and before the Governing Body of the City of Lubbock, Texas, to all persons owning or claiming any property abutting any part or portion of said streets described in Section ii, of this Resolution, as well as all owning or cla g any interest any such property. Such hearing shall be given and held on the day of „1950, at 1.30 ofclock on the second floor in the City Hall, City of Lubbock., Texas and the City Secretary is hereby directed to give notice of the time and place of such hearin_;, and of, other matters and facts in accordance with the terms and provisions of an Act passed at the first called session of the' %Oth Legislature of the State of Texas and knovm 'as Chapter 106 of the Acts of said Legislature which has been adopted as an amendment to and made a part of the Charter ,of the City of Lubbock, Texas, Such Notice shall be by advertisement inserted at least three times in a newspaper published in the City of Lubbock, Texas; the first publication shall be made at least ten days before the sai hearing. Said Notice shall con-ply with and be in accordance with the terms and provisions of this resolution and said Act.
