Hunter, thereunto duly authorized, executed contracts on behalf of the City of Lubbock with the Uo S. Public'Nousing'Administration; said contracts being desig- nated as "Tex-V-41910 and Tex-VN-4191,K for the purpose of providing certain fa- cilities for temporary housing at Lubbock Army Air Field, pursuant to Title V, as amended, of the Lanham Act. WHEREAS, said contracts were executed pursuant to an application dated April 4, 1946s and made by the City of Lubbock '(Lubbock Housing Authority) for living units to be used at said Air Base, and, WHEREAS, said contracts provide that the ..net revenues from operation of the project shall be paid to the Treasurer of the United States, and pursuant to the before-mentioned application and contracts, the Housing Authority of the. City of Lubbock as agent, of the City of Lubbock, proceeded to manage said propertp, -which contracts and projects were also designated as HA (V-41910) UPH-1 and HA (VN-41911) MPH-1, and a complete audit of the books of the Lubbock Housing Au- thority was made immediately following September 30, 1949s and demand has been made upon the City of Lubbock by the U. S.Department of Justice, acting through Frank B. Potter, U. S. Attorney for the Northern District of Texas, at Fort Worth, by letter dated January 6, 1950, and for the principal sum of $165,982.20. V EREAS, the Housing Authority of the City of Lubbock has delivered to the City of Lubbock a Cashier's Check, No. 74127, dated January 24, 1950, issued by the First 'National Bank, at Lubbock, Texas, and payable to the order of the City of Lubbock and Treasurer of the United States, for the sum of $165,991.71, and it is the desire of the governing body of the City of Lubbock that said Cashier's check be properly endorsed to the Treasurer of the United States, and tendered in compromise for the full and final payment,settlement and satisfaction of the claim 1, II of the United States against the City of Lubbock, relating to the administration and management and accounting for all net revenues to the U. S. Government, in connection with the projects at Lubbock Army Air Field, THEREFORE, I BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LU$BOCgt l� That W. H. Attorney for the Northern District of Texas, at Fort Korth, Texas, together with a letter of transmittal stating that the amount is being offered in compromise in full and final payment, settlement and satisfaction of the claim made against the City of 012150 Lubbock. AND BE IT YURTHER'RESOLVED that the letter of transmittal advise that the 19 42 Model 1-1/2 Ton Pickup Truck and Brief Case mentioned in the letter from the Department of Justice, is in possession of Mr. J. A. Maynard, Lubbock Housing Authorityp 323 Avenue F, Lubbock, Texas, for delivery to the United States Govern- ment* AND IT IS SO ORDERED.
