RESOLUTION
XIMPYAS, Fronia S. Johnston has attempted to interferewith the construction
of the highway at and near 4th Street at the North part of Block 14, Original
Town of Lubbock, Texas, and her acts and conduct toward workmen on this project
was causing unwarranted delay in the construction of said highway and it was .
deemed necessary and expedient to file a petition seeking an injunction and
temporary restraining order preventing the said Fronia S. Johnston from further
interfering with the workmen and others participating in the construction of
said highway and said suit has been filed and the temporary restraining order
granted in Cause No. 16,305, in the 99th District Court of Lubbock County, Texas,
styled City of Lubbock vs. Fronia S. Johnston, and the writ of injunction has
been served on her by the sheriff of Lubbock County, Texas: and work has been
resumed by Ernest Lloyd, General Contractor and the officers and employees of
the Texas State highway Department, THEREFORE,
BE IT RESOLVED BY THE CITY COPAU SSION OF THE CITY OF LUBBOCKt
THAT all acts performed by M. R. Smith, Jr., City Manager and Vaughn E.
Wilson, City Attorney in connection with said suits the filing thereof and
securing the temporary restraining order and prying for- a temporary injunction
against the said Fronia S. Johnston, BE, and the said acts of said officers are
hereby in all things ratified and confirmed and said officers. are hereby further
authorized to prosecute such suit or any other suits necessary or incidental
thereto, to final conclusion.
On motion by Commissioner PE,ice 'seconded by Commissioner Strikes-
2 e foregoing resolution was unanimously passed by the City Commission this the
day of November, 1948.
