WHEMAS, the City Commission of the City of Lubbock deems it necessary to acquire
water supply sources, easements, well sites and tracts of land necessary and inci-
dent to increasing and furnishing an adequate water supply to the people of the
City of Lubbock, in the interest of public health, safety and welfare, and,
NBEREAS, the City Commission has been advised through the United States Geologi-
cal Survey and the Texas State Board of Water Engineers that lands generally in a
Northeasterly direction from the City of Lubbock contain abundant water bearing sand ,
and H. N. Roberts and Associates, Consulting Engineers, and Parkhill, Smith and
Cooper, Consulting Engineers have advised the City Commission that the tracts of
land hereinafter described are in such area and will afford a proper, economical and
practical source for water supply, and,
WHEREAS, the City of Lubbock has been unable to agree with owners of the property
hereinafter dewcribed, on the amount of compensation to be paid them or each of them
for the interest required in said lands by the City of Lubbock for such water develo -
meat purposes outside the City Limits, and the City is unable to purchase the needed
tracts of land or an easement therein by reason of the owners refusing to accept
offers made by the City therefor, and the City Commission now finds that they are
put to the necessity of acquiring certain tracts of land, easements and rights-ef-
way by condemnation proceedings, and the City Commission finds that acquisition
thereof immediately is in the public interest, TBERVORE,
BE IT RESOLVED BY THE CITY COMKISSION OF THE CITY OF LUBBOCK&
THAT, the hereinafter described tracts of land are needed for well locations,
well sites and water supply sources for the City of Lubbock's water system.
THAT, the City Attorney, BE, and he is hereby authorized and directed to insti-
tute condemnation proceedings to acquire the following described tracts of land
for well locations, well sites and water supply sources needed by the City of
Lubbock to improve and enlarge its water supply system, together with easements, and
rights-of-way required to connect the following described well sites with the City's
water system, said tracts, easements and rights-of-way being as follows to wits
FIELD NOTES - No. 1 WELL SITE
Field notes for a tract of land out Section 5, Block A, T. T. R. R., Certificate
No. 396, Lubbock County, Texas, described by metes and bounds as fellowas
Beginning at a point in the west line of said Section 5, Block A, Lubbock County,
Texas, at the intersection of said west line of Section 5, Block A, with the center
line of the Crosbyton South Plains railrend, said point being approximately 2764.4
feet south of the northwest corner of said Section 5, Block Al
Thence South 55.33 feet along the west line of said Section 5, Block A, to a
point for the northwest corner of the tract;
Thence South 238.54 feet, along the west line of said Section 5, Block A,
to a point for the southwest corner of this tract;

Thence East 200 feet for the southeast corner of this tract;
Thence North 333.33 feet to a point in the south right-of-way line of the
Crosbyton South Plains Railroad Company for the northeast corner of this tract;
Thence South 64 a-381-15N nest 221,33 feet along the Crosbyton South Plains
Railroad CompaV right-of-way to the northwest corner of this tract.
Said tract containing 1.31 acres of land less that portion of said tract which
is included in the county roads along the west and north side of said tract.

Field notes for a tract of land out of Section 5, Block A, T. T. R. R., Certifi-
cate No. 396, Lubbock County, Texas, described by metes and bounds as follows:
Beginning at a point in the west line of said Section 5, Block A, Lubbock County,
Texas, at the intersection of said west line of Section 5, Block A, with the center
line of the Crosbyton South Plains Railroad, said point being approximately 2764.4
feet south of the northwest corner of said Section 5, Block A;
Thence north 64°-38'-15" East, along the center line of the railroad, 2904•82
feet to a point;
Thence south 83 feet to a point in the south right-ef-way line of the Crosbyt®n
South Plains 'Railread for the northwest corner of this tract;
Thence South 238.54 feet to a point for the Southwest corner of this tract;
Thence East 200 feet to a point for the southeast corner of this tract;
Thence North 333.33 feet to a point In the south right-of-way line of the
Crosbyton South Plains Railroad for the northeast corner of this tract;
Thence South 64°-38'-15N Nest, along the south right-of-wavy line of the Crosbyton
South Plains Railroad, 221.33 feet to the northwest corner of this tract;

cate No. 396, Lubbock County, Texas, described by metes and bounds as follows:
Beginning at a point in the east line of said Section 5, Block A, Lubbock County,
Texas, at the intersection of said east line of Section 50 Block A, with the center
line of the Crosbyton South Plains Railroad, said point being approximately 302.3
feet mouth of the northeast corner of said Section 59 Block A;
Thence South 55.33 feet, along the east line of said Section 5, Block A, to a
point for the northeast corner of this tract;

point for the southeast corner of this tract;
Thence west 200 feet to a point for the southwest corner of this tract;
Thence North 238.54 feet to a point in the south right-cif-way line of the Crosby-

Beginning at a point in the south line of said Section 5, Block A, which point is
2640 feet east of the southwest corner of said Section 5, Block A, for the southeast
corner of this tract;
Thence North 200 feet to a point for the northeast corner of this tract;
Thence West 200 feet to a point for the northwest corner of this tract;
Thence South 200 feet to a point in the south line of said Section 5, for the
southwest corner of this tract;
Thence East 200 feet, along the south line of said Section 5, Block A, to the
place of beginning;
Said tract containing 0.918 acres less that portion of said tract included in
a county road along the south side of said tract.

Field notes for a pipe line right-of-way easement in Section 59 Block A, T.T.R.R.
Certificate 396, Lubbock County, Texas, the said pipe line to be located approxi-
mately on the location described as follows;
Beginning at a point which is approximately 200 feet north and 2511.6 feet east
of the southwest corner of said Section 5, Block A; thence along a line bearing
north 25*-211-450 west approximately 3118.2 feet to a point in the south line of the
Crosbyten South Plains Railroad right-of-way, said point being approximately 3017.7
feet north and 1175.9 feet east of the southwest corner of said Section 59 Block A.
The right-of-way easement being of sufficient width to permit the grantee to lay,
maintain, operate and remove a pipe line for the transportation of water, such ease-
ment to be not exceeding 50 feet in width during construction and/or removal and not
exceeding 7-1/2 feet on either side of pipe line for maintenance together with full
rights of ingress and egress when required.

Field notes for a tract of land out of Section 50 Block A. T. T. R. R., Certifi-
cate 396, Lubbock County, Texas, described by metes and bounds as follows
Beginning at a point in the east line of said Section 5, Block A. which point is
1400 feet north of the southeast corner of said Section 5, Block A, for the south-
east corner of this tract;
Thence Test 200 feet to a point for the southwest corner of this tract;
Thence North 200 feet to a point for the northwest corner of this tract;
Thence East 200 feet to a point in the east line of said Section 59 Block A, for
the northeast corner of this tract;
Thence South 200 feet, along the east line of said Section 5, Block A, to the
place of beginning;
Said tract containing 0.918 acres, less that portion of said tract included in
a county road along the east side of said tract.

Certificate 396, Lubbock County, Texas, the said pipe line to be located approximate-
ly on the location described as follows
Beginning at a point which is approximately 1600.0 feet north and 128.4 feet west
of the southeast corner of said Section 5, Block A; thence along a line bearing
north 25"-21'-45" west approximately 2981*0 feet to a point in the south line of the
Crosbyton South Plains Railroad right-of-way, said point being approximately 4296.4
feet north and 1406.6 feet west of the southeast corner of said Section 5, Block A.
The right-of-way easement being aVaufficient width to permit the grantee to lay,
maintain, operate and remove a pipe line for the transportation of water, such ease-
ment to be not exceeding 50 feet in width during construction and/or removal and not
