WHEREAS, the City Council of the City of Lubbock deems it to be in the
best interest of the citizens of the City of Lubbock and of the other cities
of this State to seek the support of the Texas Municipal League with regard to
certain matters requiring legislative action, and
WHEREAS, such matters as are hereinafter set out are deemed by the City
Council of the City of Lubbock to be of great importance to the citizens of
the City of Lubbock and the citizens of all other cities of this State; and
WHEREAS, the City Council of the City of Lubbock desires that the Resolu-
tions Committee of the Texas Municipal League give the following matters con-
sideration for action during the upcoming legislative session; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT a concerted effort be made by the cities of this State to remove
from Vernon's Ann.Civ.St., Art. 1446c, any requirement that city owned and
operated utilities must obtain a Certificate from the Public Utilities Com-
mission in order to extend service into newly annexed areas of a city; and
THAT such amendment to the Public Utilities Regulatory Act will promote
competition in those areas where it still exists and will be in the best
interest of the citizens of the City of Lubbock and the citizens of other
cities similarly situated throughout the State; and
THAT the City Manager of the City of Lubbock or his staff is hereby
authorized and directed to forward a copy of this Resolution to the Resolu-
tions Committee of the Texas Municipal League.
