HomeMy WebLinkAboutResolution - 1222A - Support Legislation Amending Public Utility Regulatory Act - 09_23_1982RESOLUTION 1222-A - 9/23/82 TML Legislation DGV:js RESOLUTION WHEREAS, the citizens of the City of Lubbock have owned and operated their own electric utility since 1916; and WHEREAS, certain aspects of the new Public Utility Regulatory Act, Vernon's Ann.Civ.St., art. 1446c, have heavily burdened the operation of such utility on behalf of the citizens of the City of Lubbock; and WHEREAS, said Public Utility Regulatory Act because of its certification requirements long delays expansion into newly annexed areas of the City of Lubbock by Lubbock Power and Light and Water; and WHEREAS, such delays prevent some citizens from having the same utility service as other citizens enjoy; and WHEREAS, such delays cause unnecessary expense due to the fact that it would be more economical to install underground alley service at the same time lines to serve street lights and traffic signals and other City facilities are installed; and WHEREAS, such delays give Lubbock Power and Light and Water competitors a competitive advantage by unduly delaying the ability of the City's utility to offer service to newly developing areas; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the City Council of the City of Lubbock hereby gives its support to legislation amending the Public Utility Regulatory Act to provide that City owned and operated utilities may provide service anywhere within the boundaries of the municipality without the necessity of obtaining a Certificate from the Public Utilities Commission; and THAT the City Council of the City of Lubbock believes such amendment to the Public Utilities Regulatory Act will serve to promote competition in those areas in which competition still exists; and THAT the City Council of the City be in the best interest of the citizens of all citys owning and operating their Passed by the City Council this 23rd ST: yn 6-VAga, -,city 5et:reltapyp'ireasurer of Lubbock believes such amendment will of the City of Lubbock and the citizens own utilities. day of Se mb 19 BILL R, YOR APPROVED AS TO CONTENT: APPROVED AS TO FORM: Jim %Iagg, Assistant Manager Donald G.
