Said Amendment is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. MCDOIGAL, MAYOR ATTEST: cpako'c Z—ne' — Rebecca Garza, City Secretary APPROVED AS TO CONTENT: J Richard Burdine Assistant City Manager APPROVED AS TO FORM: William de Haas Contract Manager/Attorney gs/ccdocs/Contract-Amendment-TTU bus serv.res August 19, 2002 Resolution No. 2002 RO336 AMENDMENT #1 to AGREEMENT BETWEEN CITY TRANSIT MANAGEMENT COMPANY, TEXAS TECH UNIVERSITY AND TEXAS TECH UNIVERSITY HEALTH SCIENCES CENTER AND THE CITY OF LUBBOCK This amendment to the Agreement, ("Original Agreement") dated January 25, 2001, between the City Transit Management Company ("Company"), the City of Lubbock, a Home Rule Municipal Corporation ("City") and Texas Tech University and Texas Tech University Health Sciences Center ("University") for campus bus service, is made and entered between the parties August 29, 2002, ("Effective Date"). WHEREAS, Company and City entered into Original Agreement with University, dated January 25, 2001, for campus bus service; and WHEREAS, all parties desire to amend the Original Agreement; and NOW THEREFORE, for and in consideration of the mutual covenants herein, the parties agree to amend the.Original Agreement as follows: 1. Article II. Section E. is amended to change, "A minimum of 17,504 hours or service at a base rate of $36.00 per hour, for a total of $630,144." to "A minimum of 24,831 hours or service at a base rate of $36.00 per hour, for a total of $893,919." 2. Article H. Section F. amended to change, "A minimum of 10,203 hours or service at a base rate of $36.00 per hour, for a total of $367,308." to "A minimum of 13,890 hours or service at a base rate of $36.00 per hour, for a total of $500,028." All other provisions contained in the Original Contract shall remain in full force and effect and shall not be affected by this Amendment. Page 1 of 2 EXECUTED as of the Effective Date. Gilbert W"l-_r�c� ) Vice President for Fisca� Affairs REVIEWED FOR FORM TEXAS ECH UNIVERSITY Pat Ca bell General CounKel Page 2 of 2 Resolution No. 2002—RO337 August 29, 2002 Item No. 33 PROJECT NO. 9516 2001 ASSESSMENT PAVING PROGRAM RESOLUTION A RESOLUTION APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVEMENTS OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS IN THE NATURE OF GRADING, CONSTRUCTING CURB AND GUTTER, AND PAVING PORTIONS OF CERTAIN STREETS, HIGHWAYS, AVENUES AND/OR ALLEYS ALONG THE BOUNDARY OF SAID CITY, FIXING THE TIME AND PLACE FOR A HEARING FOR THE OWNERS OF ABUTTING PROPERTY AND OTHER PERSONS INTERESTED IN SAID PROPERTY, AND DIRECTING THE CITY SECRETAY TO PUBLISH NOTICE OF SAID HEARING ON BEHALF OF THE GOVERNING BODY OF THE CITY OF LUBBOCK, TEXAS. WHEREAS, the City Council of the City of Lubbock has heretofore ordered that portions of streets, highways, avenues and/or alleys be improved by grading, installing concrete curb and gutter, reinforced concrete alley pavement, and street pavement with caliche base and/or asphalt stabilized base and one and one-half (1 1/z) inch asphalt surface, together with incidentals and appurtenances; and WHEREAS, the City Council of the City of Lubbock has caused the City Engineer to prepare and file estimates of the cost of such improvements and estimates of the amount per front foot to be assessed against abutting property and the owners thereof, and such estimates have been prepared and examined; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT such estimates be and are hereby adopted and approved. SECTION 2. THAT notice of a hearing be given to the owners of property abutting upon the herein below mentioned portions of streets, highways, avenues and/or alleys, and to all others interested in said property. The Governing Body of the City of Lubbock has heretofore ordered that the following portions of streets, highways, avenues and/or alleys in and along the boundary of the City of Lubbock, Texas, be improved by raising, grading, filling and installing concrete curbs and gutters, minimum five (5) inch thick reinforce concrete alley pavement, street pavement with caliche base and/or asphalt stabilized base and
