HomeMy WebLinkAboutResolution - 011432A - Street Improvements - City Engineer - Portions Of North Avenue H - 01_14_1932 .r + 011 2=A RESOLUTION ORDERING AND PROVIDING FOR 1.:PROVF- 14WTS ON A PORTION OF NORTH AVENUE " H" IN THE CITY OF LUBBOCK, TEXAS, PROVIDING HOW SUCH IM- PROVEMENTS SHALL BE PAID FOR AND DIRECTING THE CITY WGII'EER TO PREPARE AND FILE PLANS AND SPECIFICATIONS. BE IT RESOLVED BY THE CITY OF LUBBOCK, TEXAS, THAT: I. There exists a public necessity that the following portion of North Avenue "H", in the City of Lubbock, Texas, be improved as herein provided, to wit: NORTH AVWUE "H" FR%1 A LINE ACROSS SAID AVENUE 236.7 FEET SOUTH OF THE SOUTH PROPERTY LINE OF FOURTH STREET TO ITS INTERSECTION WITH THE NORTH PROPERTY LINE OF SANDERS STREET ( FOWERLY FIRST STREET), KNNOW AND DESICUATED AS UNIT ORMSTRICT NO. 38. I I. It is hereby orae red that said portion of Avenue "H" shall be improved by raising, grading and filling same and by installing concrete curbs and gutters and storm sewers and drains where necessary and by paving with one of the following types of material on proper foundation, to wit: (a) 2— Inch Vertical Fibre Brick (b) Inch Cold Rolled. Oklahoma Rock Asphalt. (c) 1— Inch Warrelite Bitulithic. (d) lr+ Inch Asphaltic Concrete. III. In Providing for and making such improvements, the City Commissiau deems it advisable to proceed under and in exercise of the powers, terms and provisions of Chapter 106, of the Acts of the First Called Session of the Fortieth Legislature of the State of Texas, which has been adopted as an amendment to,and made a part of, the charter of the City of Lubbock, Texas. IV. The improvements on said portion Of Avenue "E" shall be paid for in the fallowing manner, to-wit: (a) The abutting property and owners thereof shall be assessed and pay for not exceeding all of the cost of constructing curbs and gutters, plus nine—tenths (9/10ths) of the remaini g cost of said improvements, ex— clusive of the cost of constructing storm sewers. (b) After deducting the suns to be paid by and finally assessed against abutting property and the owners thereof, the remaining cost of the improvements, including all of the cost of constructing storm sewers, shall be paid by the City of Lubbock, Texas, provided, however, that no assessment shall be levied until after notice and hearing as provided and required by law, and the assessments shall be subject in all respects to the provisions of said law and particularly with reference to special benefits. 1 NO J Y V. o r 4-32 A Assessments against the abutting property and owners thereof shall be payable in three (3) equal installments, uue respectively on or before ten (10) days, One (1) and Two (2) Years after the completion and accep.. tance by the City of the improvements on said portion of Avenue "H", and shall bear interest from the date of such completion and acceptance at the rate of seven (7%) per cent per annum, payable annually, provided that if default be made in the payment of any installment of principal or interest promptly as the same matures, then the entire assessment upon which default is made shall, at the option of the owner and holder of such assessment or of the certificate in evidence thereof, be and become due and payable and shall be collectible with reasonable att orney's fees and costs of collection if incurred. All assessments shall be a lien and liability as provided in said law. Vi. As is provided in said law, the improvements may be omitted in front of any property exempt from the lien of special assessment for street Improvements without invalidating assessments against other property. Vill . The City Engineer for the City of Lubbock is directed to prepare and file with the City Canmission plans and specifications for such improve. ments covering the types of pavement hereinabove set forth.
